Will of Susannah Warne

In re SUSANNAH WARNE: DECEASED.

This name is spelled Susannah and Susanna in the will, and Susannah in the will index.

In the name of God Amen. I Susannah Warne late of the Town and County of Poole in Dorsetshire, England, Widow and relict of James Warne of Saint John’s Newfoundland Mariner, my late husband deceased, being of sound memory and understanding but weak in body make this my last will and testament as follows, that is to say, I give and bequeath subject to the payment of my just debts, funeral expenses and the probate and execution of this my last will, all my property whether real or personal of what nature or kind soever in Newfoundland and in England unto Newman Wright Hoyles and Charles James Fox Bennett of Saint John’s aforesaid, their executors, administrators and assigns upon trust that they my said Trustees, their and every of their executors administrators and assigns, shall and will yearly and every year during the life of my beloved daughter Susanna Weston Harie, pay or cause to be paid all the rents profits and product of my real and personal estate in Newfoundland and England aforesaid, unto the proper hands of her the said Susanna Weston Haire and for her own sole and separate use and benefit, or to such person or persons, as she by any writing signed with her proper hand shall from time to time notwithstanding her present or any future coverture, direct or appoint. And my will is that the present or any future husband shall not intermeddle therewith, neither shall the same be subject or liable to his controul debts or engagements, and the receipt of her the said Susanna Weston Haire, signed with her proper hand shall be a good and sufficient discharge for so much of the rents and profits of my said estate as shall be therein acknowledged and expressed to be received. And further my will is that after the decease of my said beloved daughter Susanna Weston Haire that the residue of my property as aforesaid be equally divided in just proportions between the female children of her the said Susanna Weston Haire on her body begotten by her present husband Alexander Haire or to be begotten And lastly I do hereby nominate constitute and appoint Newman Wright Hoyles and Charles James Fox Bennett aforesaid my executors and Susanna Weston Haire aforenamed my executrix of this my last will and testament and do hereby revoke and make void all former and other wills by me at any time heretofore made and do declare this to be my last will and testament.

In witness whereof I the said Susanna Warne have hereunto set my hand and seal this sixth day of February in the year of our Lord one thousand eight hundred and twenty three.

Notwithstanding my last will and testament I do hereby give unto Henry James Jackson the lawful son of my said daughter Susanna Weston Haire by her former husband Henry Miller Jackson deceased an eight day clock and a double chest of drawers now in the possession of my sister Mary Turber residing in the town and county of Poole Dorsetshire, England,
