In re: ROBERT J. GEAR. DECEASED
I Robert Joseph Gear of St. John’s Newfoundland Engineer Declare this to be my last and true will and Testament.
1. I give and bequeath to Annie Ryall daughter of William J. Ryall of Brooklyn New York, The House and premises on water street now held under lease by Thomas McCarthy and forming part of the Estate Known as the Angel estate and bequeathed me by my late wife; to be hers absolutely.
2nd. To my Godson William Scott of St. John’s Engineer I give all my Shooting & fishing appliances
3rd. In consideration of all the attention and kindness shown me and my late wife by my friend Charlotte Lydia Rendell daughter of the late Charles Rendell of Hearts Content. I will, devise & bequeath for her benefit, and to enjoy during such time as she remain unmarried, all my land and Dwelling House situated, and numbered 15 Gower Street, Also all Interest derived from Stock held in the Empire Woodworking Company of St. John’s, also from Five Hundred and fifty Dollars loaned the Newfoundland British Society, Also that derived from my interest in the Estate known as the Angel Estate and all monies and property whatsoever and wheresoever situated at the time of my death. It is also my will with regard to all my Household Furniture and effects, that the aforesaid Charlotte Lydia Rendell have full power, to sell the same furniture and effects, if it be to her more convenient and enjoy the Interest to be derived from the proceeds thereoff. In the event of the marriage of the aforesaid Charlotte L. Rendell I will and bequeath her Two Hundred Dollars, to be hers absolutely with no further claim on my Estate. In the event of the marriage or death of the aforesaid Charlotte Lydia Rendell. I give and bequeath to my neice Bessie McGreggor, one half interest in my Dwelling House and land situated on Gower Street & numbered 15.
To my nephew Robert Gear McDonald I give & bequeath the remaining one half interest in the aforesaid Land and Dwelling House. Also any remaining unpaid amount of Loan, loned by me to the said Robert G McDonald and also Five Hundred and fifty Dollars loned the Newfoundland British Society, in the event of or at the death of my friend Frederick Collins.
To my neice Margaret Leo of Brooklyn New York I give and bequeath the interest derived from my stock in the Empire Woodworking Company of St. John’s for her benefit during her life time.
To the family of the Late Charles Ryall brother of my late wife. I give all my Interest in the Estate known as Angel Estate and bequeathed me by my late wife. And at the death of my niece Margaret Leo of Brooklyn. I bequeath to the said family of the Late Charles Ryall of Toronto Canada, one half of my stock in the Empire Woodworking Co. Also at the death of the aforesaid Margaret Leo. I give & bequeath to May Ryall wife of William J Ryall of Brooklyn the remaining one half of of my stock in the aforesaid Company.
To my friend Frederick Collins of St. John’s, to enjoy during his lifetime I give & bequeath the Interest derived from Five Hundred & fifty dollars loned the Newfoundland British Society.
It is also my will that if my Household Furniture and effects be not sold before the marriage or death of my friend Charlotte L. Rendell that it be then sold and the proceeds together with other monies be distributed as follows, that is to say.
- To my dear Sister Martha O’Conner wife of Patrick O’Conner of Brooklyn New York I give Two Hundred Dollars.
- To Samuel Ryall of St. John’s brother of my late wife I give Three Hundred Dollars
- To my Godson Ernest Williams of St. John’s, woodworker I give one Hundred
- To my Godson William Scott St. John’s Engineer I give one Hundred Dollars
- To the managers of the Church of England Orphanage I give Two Hundred Dollars to be devoted to a fund the Interest of which to be used in the event of sickness
- Further it is my will that one Hundred Dollars be invested, the Interest of which to be devoted to the up keep of the family plots in the Church of England Cemetery.
- If there be any residue not herein before given or disposed of, after payment of my just debts, funeral expenses, and Expenses of Proving this my will and Testament I hereby give and bequeath the same to the managers of the Church of England Orphanage for the benefit of the before mentioned fund, for the sick
And finally I hereby appoint, and make my friend Charlotte Lydia Rendell executrix and my nephew Robert Gear McDonald executor to this my last will & testament. In testimony whereof I the said Robert Joseph Gear have hereunto subscribed my name at St. John’s this Eleventh day of February one Thousand nine Hundred & nine Rob Joseph Gear Signed, published & declared by the said Robert Joseph Gear on the above date, in our presence who in his presence, and in the presence of each other have hereunto affixed our names as witnesses.
