Will of Robert William Facey

IN RE:   ROBERT WILLIAM FACEY.    DECEASED

This is the last Will and Testament of me Robert William Facey of No 10 Murray Street Saint Johns in the Dominion of Newfoundland

I hereby revoke all wills and testamentary instruments heretofore by me made

I appoint my sons Nicholas S Facey and Hugh W Facey to be the Executors of this my will, I direct my Executors to pay my just Debts and Funeral and Testamentary Expenses I wish my executors to act as Trustees for the management of my real property, viz two tenement houses Nos 111 and 113 Longs Hill St John's and Nos 4, 6, 8, and 10 Murray Street St John's for the benefit of my daughter Ella until her marriage or decease, giving them power to sell the whole or any part of the property and make other investments with the proceeds if at any time they consider it to be to the Interest of my estate and my daughter aforesaid to do so; but whatever form my property is in I wish my daughter Ella to have the rental or interest or other benefits accruing from it untill her marriage or decease except that as my son John W. Facey has three hundred Dollars ($300) invested in the Murray St property and has never received and benefit from it

I direct my Trustees when the property is sold and they are in a position to do so to repay this sum together with interest at Five per cent from September 1905 up to the date at which it is repaid On my daughters Ella's marriage or decease, and after the sum mentioned above with Interest has been paid to my son John, I direct that this property in whatever form it is to be divided between my six children or their heirs share and share alike I give devise and bequeath all my household furniture, plate linen, ornaments, and other household effects being in and upon my dwelling House No 10 Murray Street St John's and all my real and personal property of whatever nature or kind soever not hereinbefore otherwise disposed of to my said daughter Ella.

In witness whereof I have to this my last will set my hand, this 26th day of August 1824. (Sic)

Signed by the above named as his last will in the presence of us both, being present at the same time, who in his presence and in the presence of each other have hereunto subscribed our names as witnesses.
