In re: PETER ELLARD. DECEASED
In the name of God Amen The last will and testament of Peter Ellard of Torbay South District St. John's East Farmer Fisherman made this Sixth day of October Nineteen hundred and nine. I Peter Ellard being very sick and indisposed in bodly health - but of perfect and sound mind and understanding - and calling to mind the frailty and uncertainty of human life and that it is appointed for men once to die:- Therefore I am desirous to settle my worldley affairs and dispose of the Estate with which it has pleased God to bless me with shall be disposed of after my decease while I have strength and capacity to do so do make and publish this my last will and testament, hereby making null and void all other wills and testaments by me at any time heretofore made-
First - I constitute my son John Ellard Sole Executor of this my last will and testament desiring him to pay all my just debts and funeral expenses out of my Estate - I do also will and bequeath to my son John Ellard half my dwelling house situated at Torbay aforesaid and the apertances of its half Together with the Land adjoining my Dwelling house and half the land on the hill and half Kerwins purchased land and half the Birchey hill farm also the land on the south side of the road opposite the Dwelling houch to the Bounds of the little meadow together with live stock three Cows and three horses and their Belongings carts and cars Carriage and their apertances Secondly - I hereby will and bequeath to my son Patrick Ellard the other half of my dwelling house aforementioned Together with the apertances and half the land on the hill and the little meadow south of the road and half the Birchey hill farm and half the purchased land of Kerwins Together with live Stock three Cows and two horses with their belongings further I do will and bequeath that the Barns outhouse adjoining my dwelling house shall be the property of my son John Ellard but at present my son Patrick shall have a share of them until he builds a barn for himself and that is all Peter his x mark Ellard. Signed Sealed published and declared by the said Peter Ellard as and for his last will and testament in presence of us who the presence of him and at his request have subscribed our names as witnesses hereto witnesses John Roche Michael Druken
