Will of Patrick Brazil from Newfoundland will books volume 4 pages 159 to 161 probate year 1881

In re
          Patrick Brazil deceased.

In the name of God Amen.     I Patrick Brazil of Saint John’s in the Island of Newfoundland, Gentleman, do make publish and declare this paper writing to be my last will and testament and I hereby annul and revoke all former wills by me made or executed-     I give devise and bequeath unto my brother William Brazil All that piece or parcel of land situate at Mondays Pond containing about thirty acres and adjoining property of said William Brazil-     I also give devise and bequeath unto my said brother Wm. Brazil all houses and land belonging to me situate in Waldegrave Street I also give devise and bequeath unto my said brother William Brazil all my right title and interest of in and to the farm known as the “Old Farm” also the Field known as Bindon’s Field adjoining the same situate on the Lazy Bank Road and at present held by me and the said William Brazil I also give devise and bequeath unto the said William Brazil all monies belonging to me that I may die possessed or be entitled to at the time of my death whether deposited in the Newfoundland Savings Bank now in the house I reside in or elsewhere-     All the foregoing bequests are upon the express condition that he the said William Brazil do pay or to cause to be paid to the Parish Priest for the time being of River Head for and to be applied towards St. Patricks Church River Head the sum of ten pounds per year for four years after my decease And also shall and will pay or cause to be paid unto my brother John Brazil the sum of fifteen pounds currency per year during the term of his natural life This amount to be paid the said John Brazil half yearly     I give devise and bequeath unto my nieces Mary Francis Brazil and Alice Brazil the house on New Gower Street at present occupied by Miss Quirk also the house occupied by Wm. Pope also a house in the rear of said Pope’s house now in possession of George Buckingham I also give and bequeath unto my niece Mary Francis my own bed and bedding and to my said niece Alice a feather bed.     The above property to be free from the control of any husband they or either of them may have.     I give devise and bequeath unto my nieces Katie and Maggie Brazil the ground leased by me to James Daley also the house and land in the occupancy of Mrs. Courtney situate in Caseys Lane free from the control of any husband they or either of them may have.     I give devise and bequeath unto my nephew Patrick Brazil my Gold Watch and chain     I give devise and bequeath unto my five nephews viz Patrick, Richard, William, John and David Brazil all other property of every description and wheresoever situate that I may die possessed or be entitled to share and share alike.     I hereby nominate and appoint my said brother William Brazil sole executor of this my last will and testament.     In witness whereof I have hereunto subscribed my name this twenty first day of May Anno Domini one thousand eight hundred and eighty one.     Patrick Brazil.     Signed published and declared by the said Patrick Brazil as and for his last will and testament in our presence and in presence of each other who have at the request of said Patrick Brazil and in his presence subscribed our names as witnesses hereto the word “Brazil” being first interlined on this page, M.J. O’Mara,     Michael Wall.

I Patrick Brazil within named do make publish and declare this codicil to be part of the within and foregoing will executed by me on the twenty-first day of May instant.     The bequests named in within and foregoing will to my nephews and nieces not to come into effect operation until my niece Margaret shall attain the age of twenty one years and in case of her death then until the youngest of my said nieces and nephews shall attain the age of twenty one years aforesaid     All the property within mentioned bequeathed to my said nephews and nieces specified or otherwise to be held in trust by my said brother William Brazil until the youngest shall attain the age of twenty one years aforesaid The rents issues and profits arising out of the property within bequeathed unto my said nephews and nieces to be applied by the said William Brazil for and towards the support maintenance and education of my said nephews and nieces until the youngest shall attain the age of twenty one years aforesaid     In witness whereof I have hereunto subscribed my name this 23rd day of May A.D. 1881.     Patrick Brazil.     Signed published and declared by the said Patrick Brazil as and for a codicil to within will in our presence and in presence of each other and who have at the request and in presence of said Patrick Brazil subscribed our names as witnesses hereto.     M.J.
