Will of Patrick Kane from Newfoundland will books volume 2 page 494 probate year 1863

In re
          Patrick Kane deceased.

In the name of God Amen. I Patrick Kane of Saint John's in the Island of Newfoundland Farm Labourer do make and declare the following to be my last will and testament.

First I give and bequeath unto my sister Catharine Kane of Dungarvon in the County of Waterford Ireland the sum of twenty five pound currency of Newfoundland and in case of the death of my said sister before receiving said sum the said sum to go and I hereby bequeath it unto my said brother James Kane hereinafter named.

Second, I give and bequeath unto my said brother James Kane of Fort Bennington in the State of Vermont United States of America the sum of twenty five pounds currency aforesaid.

Third I give and bequeath unto each of the seven children of my said brother James Kane the sum of forty pounds currency aforesaid and in case of the death of any of either of the said children his her or their share or shares aforesaid to be equally divided between the surviving children of my said brother James Kane share and share alike.

Fourth I give and bequeath unto the Right Reverend Doctor Mullock the sum of ten pounds currency aforesaid for High Masses for my soul. I give and bequeath unto the Roman Catholic Orphanage of Saint John's two thirds of whatever money I may be possessed of at the time of my death after deducting the foregoing bequests the other third after deducting bequests aforesaid I give and bequeath unto my executors hereinafter named to be distributed amongst the most deserving of the Poor in the neighbourhood of where I now live. I hereby nominate and appoint Michael Cahil of Saint John's Tailor and Mr. Thomas Croaker of same place Tailor executors of this my last will and testament.

Lastly I hereby annul all former wills by me made or executed. In witness whereof I have hereunto my hand and seal subscribed and set this twenty ninth day of December Anno Domini one thousand eight hundred and sixty two. Patrick his X mark Kane (LS)
