IN RE: NATHANIEL PATTEN. DECEASED
In the name of God Amen. I, Nathaniel Petten of Middle Bight South Shore Conception Bay Newfoundland Fisherman and Farmer being very sick and weak in Body but of perfect mind and memory, do make and ordain this my last will and Testament.
First I give and bequeath to my beloved wife Elizabeth Emma and my brother George Petten my dwelling house stable and cellar, each to have an equal part. My wife is to take her choice of either end. My wife is to possess this above property while she remains in my name. I give and bequeath to my wife all my goods and chattles to possess as long as she remains in my name. I give and bequeath to my wife all my cultivated and uncultivated land for her support and the support of my children while she remains in my name - I give my horse to my wife to do as she wishes with - my cart dray and catamaran are are to remain on the premises to be used by those that occupy the place - I give my fishing boat to my brother George. And he is to help my wife to get Caplin for the land. And do all in his power summer and winter for her - I give my gun to my brother Thomas.
If my wife should marry or die my brother George is to take possession of all that I have given and bequeathed to my wife. And he is to look after my children if they should live and assist them until they would be able to work for themselves - my land and property is not to go out of my name but is to be handed down to be kept in the name of Petten - That is my part. I give and bequeath to my daughter Julia my feather bed and bedding three or four pictures and a trunk. All to remain in the house until she goes for herself. My brother George is to do all he can for my daughter Julia he is not to shut the door against her she is to come and go when she likes until she has a home of her own -
I give all my carpenters tools to my brother George he is not to lend them to any person - my clothes is to be equally divided between my two brothers Thomas and George.
The following is the boundaries of my land
- No. One. My outside land is bounded on the north by my brother Thomas' land South by John Bishop. East by Samuel Butler and west by Joseph Petten -
- No two called the cellar garden is bounded on the north by John Bishop's land south by my brother George's land. East by Samuel Butler and west by Joseph Petten.
- No three the piece I am living on is bounded on the north by the waterside road south by John Bishop. East by waterside road and west by land owned by the late Nicholas Petten.
- No four inside of the main road is bounded as follows north by Moses Kennedy south by Henry Haines. East by Fox trap river and west by Samuel Butler.
- No five land in the country is bounded on the north by local road south by John Bishop east by brother George and west by country road -
Any articles my wife possessed and brought with her or gathered she can take with her if she should marry again. And I do hereby utterly disallow revoke and disannul all and every other former Testaments wills and Bequests by me in anywise before named willed and bequeathed ratifying and confirming this and no other to be my last will and Testament.
In witness whereof I have hereunto set my Hand and seal this 13th day of March in the year of our Lord one thousand nine hundred - Nathaniel his x mark Petten (LS) - Signed Sealed published pronounced and declared by the said Nathaniel Petten having been first read over as his last will and Testament in the presence of us who in his Presence and in the presence of each other have subscribed our names as witnesses Francis F. Furneaux Commissioner of Supreme Court of Newfoundland George B. Butler.
