In re MICHAEL HYNES. DECEASED. In the name of God Amen this tenth day of July A.D. - 1869- I Michael Hynes of Portugal Cove in the Island of Newfoundland Fisherman being very sick and weak of body but of perfect mind and memory thanks be given unto God do make and publish this my last will and testament that is to say I give and bequeath all the land in my possession to my two sons Thomas and Stephen Hynes together with all the moveable and immoveable effects each of the aforesaid sons to have an equal dividend of my land cleared and uncleared and also an equal share of my effects and also that the said Thomas and Stephen Hynes shall support their two sisters Elizabeth and Mary Hynes while the said two sisters think well of living with the said two brothers and the said two sisters are bound to labour for their support as usual and should any disagreement arise between the two brothers and their sisters Elizabeth and her son Andrew the said Thomas & Stephen Hynes are bound to pay said widow three pounds currency per year until her son Andrew becomes 21 years of age I give and bequeath my dwelling house to my son Stephen Hynes and all the furniture that belongs to me to remain for the use of said dwelling house with the exception of my bed and bedding and gun and these I bequeath to my son Thos- Hynes also the use of my bedroom and a part of said dwelling house until said Thos Hynes is provided for in a house for himself and the said Stephen Hynes shall assist the said Thos Hynes in building a house as far as his means will allow him Should either Thos or Stephen Hynes leave his part of the said property for any time the absentee is bound to leave what that part produces to him that labours and remains on said property I also prohibit my sons or any of them to sell or mortgage any part or portion of my property as willed by me to them. In witness whereof I have hereunto set my hand and seal the 10th of July A.D. 1869.Michael his X mark Hynes.
