In re: MICHAEL CUDDIHY DECEASED. In the name of God Amen. I Michael Cuddihy of Saint John’s Newfoundland Stone-mason do hereby make and declare this to be my last will and testament, hereby revoking all former last wills and testaments by me heretofore made. Firstly, I desire all my just debts funeral, testamentary and otherwise to be paid by my executors or executor. Secondly, I give, bequeath and leave unto my beloved wife Catherine all my properties, goods, monies and effects of which I may die possessed, to have and to hold during the term of her natural life. Thirdly, I give and bequeath unto my son John and daughter Bridget the proceeds of the rental of two tenement houses situate off Flower Hill which are leased for a term of nine hundred and ninety nine years the preference of selection of tenancy to be given to my daughter Bridget. Fourthly, I likewise give & bequeath unto my son Michael and daughter Mary the proceeds of the rental of two tenement houses situate on New Gower Street which are leasehold, the preference of selection of tenancy to be given to my daughter Mary. Fifthly, I give and bequeath unto my daughter Mary the sum of fifty pounds currency to be paid to her within three months after the death of my wife. Sixthly I give & bequeath also to my daughter Bridget the sum of fifty pounds currency to be paid her within three months after the death of my wife. Seventhly I give and bequeath unto my daughter Annie wife of Richard Colfred of Saint John’s, Cooper, the sum of fifty pounds currency to be paid to her within three months after the death of my wife, but provided that she should die without children before her mother, then the sum of her share, fifty pounds, will be payable to my daughters Mary or Bridget which of them are then unmarried. Eighthly I give & bequeath to my granddaughter Alice Holland the sum of fifty pounds currency payable three months after the death of my wife - but should she die previous to the death of my wife her share of fifty pounds will then be payable to her brother Thomas Holland.
Lastly I desire to have as my executor whom I hereby appoint as my sole executor to this my last will and testament- Denis Dooley. In witness whereof I the testator have hereunto set my hand this 27th day of September in the year of our Lord one thousand eight hundred and eighty four. Michael his X mark Cuddihy. Signed by the testator as and for his last will and testament in the presence of us who in his presence at his request and the presence of each other have hereunto subscribed our names as witnesses, John T.
