In re: MARY SMYTH DECEASED.
This is the last Will and Testament of me Mary Smyth, of Saint John's Widow.
1. I give and bequeath to the Mount Cashel Orphanage Saint John's the sum of Three hundred dollars:
To the Belvidere Orphanage Saint John's the sum of Three hundred dollars:
to the Administrator of the Roman Catholic Diocese Saint John's for the Ecclesiastical Fund, the sum of Three hundred dollars:
to the Methodist Orphanage Saint John's the sum of Three hundred dollars:
to the Church of England Orphanage Saint John's the sum of Three hundred dollars:
to my brother James Harris the sum of Five hundred dollars:
to my sister Agnes Tobin the sum of Five hundred dollars:
to my niece Mary Doyle the sum of Five hundred dollars:
to my niece Elsie Doyle the sum of Five hundred dollars.
2. I direct my Executrix to pay to my sisters Margaret and Catherine (in religion Sisters Raphael and Calliate respectively) the sum of five dollars each every quarter during their respective lives: and to my nice Margaret Doyle the sum of Three hundred dollars per year until she marries or becomes a religious or her death whichever shall first happen.
3. I direct my Executrix to expend the sum of Five hundred dollars in Masses for the repose of my soul.
4 I give and bequeath to my daughter Anna Kearney the nett income of all the rest residue and remainder of my property lands goods moneys securities estate and effects of every description during her life. And I will and direct that if it should become necessary for the support of herself or her children or for the education of her children to use a portion of the capital she shall have power to realise such portions of my estate as may be necessary and may expend the proceeds thereof for such purposes.
5 On the death of my said daughter Anna Kearney I give devise and bequeath all the lands goods moneys securities property and effects of my estate then remaining to such of the children of the said Anna Kearney as shall be then living in equal shares: provided that no distribution of the capital shall be made until the youngest child shall attain the age of twenty one years: and that the share of any or either of the said children dying before the time of distribution shall go to his her or their respective issue then surviving (if any) and in default of such issue then surviving to his here or their brothers and sisters equally.
6. I appoint my said daughter Anna Kearney Executrix of this my Will.
