Will of Mary Molloy from Newfoundland will books volume 10 page 223-224 probate year 1914

In re     MARY MOLLOY deceased

    This is the last will of me Mary Molloy of St. John’s Spinster and I revoke all former wills by me made.     I appoint Thomas Coady of St. John’s executor and trustee of this my will.     I give my house and furniture to my trustee upon trust as follows: To sell the same as soon as he thinks convenient after my death and to apply the net proceeds as follows (a) to pay all my just debts testamentary and other expenses including a suitable headstone (b) to pay one hundred dollars each year for two years to Reverend James J. Coady (c) to pay Reverend Father Sheehan of the Cathedral St. John’s twenty-five dollars (d) to pay for Masses for the repose of my soul one hundred dollars and (e) the balance of the net proceeds to be paid my niece Catherine Molloy who now lives with me.     The residue of my estate I give to my trustee     to pay the annual income to my said niece Mary Molloy during her life and if my said niece predecease her mother Mary Molloy then the said annual income shall be paid to the latter during her life.     After the death of the survivor of them (Catherine Molloy and her mother) the said residue shall be distributed as follows (a) one hundred dollars each year for eight years for Masses for the repose of the souls of myself James Molloy Edward Molloy Catherine Molloy (mother) Catherine Molloy (niece) John Molloy and Garrett Murphy (b) Five hundred dollars each to my grandnieces Mary Molloy and Annie Molloy if they be of age if not to pay over for them to their father Edward Molloy (c) Five hundred dollars to Eleanor Coady daughter of my executor and (d) Five hundred dollars to Agnes O’Dea daughter of May O’Dea     If Agnes O’Dea die before she reaches 21 years the said Five hundred dollars is to be paid to said Ray O’Dea and if the said Eleanor Coady die before reaching 21 years the said five hundred is to be paid to my executor himself (e) The balance of said residue is to be divided equally between Mount Cashel and Belvidere Orphanages.     I give my trustee absolute discretion as to the investment of the said residue until the period arrives for the said distribution     In witness whereof I have set my hand to this my will this 19th day of March 1914     Mary her X mark Molloy     Signed by the testator Mary Molloy as and for her last will by making her mark after the said will had been first read over to her in our presence who in her presence and in the presence of each other have signed our names as witnesses (the word ‘niece’ being struck out and the word ‘dollars’ interlined on first page, and the words “Eleanor O’Dea Coady” “Coady” struck out and the words Agnes O’Dea interlined on this page.     Jas J.
