Will of Mary Barron

In re MARY BARRON: DECEASED.

In the name of God Amen, I Mary Barron of the City of Brooklyn County of Kings and State of New York Widow of John Barron deceased do make publish and declare this my last will and testament.

First, I give devise and bequeath to my daughter Margaret Kavanagh the wife of Edward Kavanagh all my clothing (including my vistorine and cuffs) also the portraits of myself and of my deceased husband also my bedstead bed and bedding one bureau one washstand one picture in my bedroom also one suit of parlor furniture including carpets (the choice of which is to be made by my said daughter) also one rosewood marble top table two pair of lace window curtains with bands and also three terra cotta vases and one pier glass.

Second, I give devise and bequeath to my daughter Elizabeth Barron my gold watch-

Third, I give devise and bequeath to each of my sons Pierce M. Barron and James J. Barron the one equal undivided half part of all my real estate situate in St. John*s Newfoundland and all my right title and interest of in and to any real estate situate in that place now belonging to me or in or to which I am now or shall or may be interested in or entitled to and also of all leases leasehold estate and property of or for lands or tenements situate in St. John*s aforesaid now belonging to me or in which I am or may be interested in or entitled to and also of all shares of the capital Stock of the Union Bank in St. John*s aforesaid now owned or belonging to me or to which I am or may be entitled To have and to hold all of the same unto the said Pierce M. Barron and James J. Barron their heirs, executors, administrators and assigns for ever. But nothing herein is to be taken or construed as releasing or discharging my said sons or either of them from the payment of their indebtedness to me and for which I hold their note.

Fourth I give devise and bequeath all the rest residue and remainder of my estate and property as well real as personal of every name and nature and wheresoever situate unto my executor hereinafter named in trust nevertheless and to and for the uses intents and purposes following that is to say, in trust that my said executor as soon after my decease as may be convenient sell and dispose of all the said rest and residue of my real and personal estate and property at public or private sale as he in his discretion may think proper and convert all of the same into money and upon the further trust that my said executor divide such money into three equal parts or shares and that my said executor pay and I give devise and bequeath one of such parts or shares of such money to my son Henry W. Barron that my said executor also pay and I give devise and bequeath one other of such parts or shares of such money to my daughter Margaret Kavanagh wife of Edward Kavanagh for her sole and separate use free from the debts control or engagements of any husband she may have. And that my said executor pay the remaining part or share of such money to my son Pierce M. Barron in trust that my said son invest such part or share in stocks of the United States or of the State or City of New York or in the capital stock of any bank or banks in the City of New York or upon bond secured by Mortgage on real estate in fee that my said son collect and receive the interest income or dividends thereof and pay or apply the same to the use of my daughter Elizabeth during her natural life for her sole and separate use and on her separate receipt free from the debts control or engagements of any husband she may have and upon the death of my said daughter Elizabeth that my said son pay or assign or divide and distribute such investment or the money arising therefrom to and among and I give devise and bequeath the same to any child or children of my said daughter her surviving and to the issue of any of them who may have died leaving issue such issue to take the share his her or their parent would have been entitled to if living and upon the further trust that if my said daughter shall die without leaving any child or children that then my said son pay assign divide and distribute such investments or the proceeds thereof to and between (and I give devise and bequeath the same) to my sons Pierce M. Barron, James J. Barron, Henry W. Barron and my daughter Margaret Kavanagh and the survivors and survivor of them and the issue of such of them as may have died leaving issue such issue to take per stirpes and not per capita the share his her or their parent would have taken if living.

Fifth, I hereby nominate constitute and appoint my son-in-law Edward Kavanagh the executor of this my last will and testament.

Lastly, In testimony whereof I have hereunto set my hand and affixed my seal this fifth day of January one thousand eight hundred and fifty seven,

I Mary Barron do make this codicil to my foregoing will.

Firstly, I hereby revoke that part of my will which gives my bedstead bureau and washstand to my daughter Margaret Kavanagh and do hereby give devise and bequeath the same to my daughter Elizabeth.

Secondly, I give devise and bequeath to my daughter said Margaret in addition to the furniture and other things given to her by the first clause of my will All my parlor furniture picture of Washington one dozen silver tea spoons, a silver cake basket silver salver glass ware in parlor pantry a sett china stair carpets & rods extension table.

Thirdly, I give devise and bequeath to the Reverend Eugene Cassidy the sum of two hundred dollars.

Fourthly I ratify and confirm my said will in all other respects.
