Will of Martin Bulger

In re: MARTIN BULGER. DECEASED

In the name of God Amen

I Martin Bulger of Portugal Cove in the island of Newfoundland being of perfect mind and memory (thanks be to God) but calling to mind the mortality of the body. Knowing that its appointed to all men to die do on this twenty second day of August in the year of our Lord one thousand eight hundred and seventy eight make and ordaine this my last will and testament That is to say first principally and first of all I give and recommend my soul into the hands of Almighty God that gave it and my body I recommend to the earth so be buried in decent christian burial and as touching such worldly estate as God has been pleased to give me in this life.

I give demise and dispose in the following manner. First to my beloved wife Mary (as long as she remains a widow) I give and bequeath all my property landed and otherwise (moveable and unmoveable) under the following conditions. viz. when my two sons David and John are by the consent of their Mother married if their Mother is living at the time the above two sons David and John are to have two thirds of that part of my property situated at First Pond containing about forty acres, the other one third containing about twenty acres I will and bequeath to my Brother John's son James the said one third being situate on the west side adjoining Edward Summers property.

To my two sons Michael and Martin, when they are married (by the consent of their Mother if alive) I give and bequeath the land situate on Princes Mount to be divided equally between them said land containing about twenty-acres or more I also will that my two daughters Ellen Mary and Mary Ann are to be supported and clad by their Mother and Brothers while the said two girls remain unmarried the residue of my property being as follows viz. properties at Beechy Cove. Whales back the gulch meadow and the property my Mother at present occupies together with my houses household furniture stables, horses carriages carts and all my farming implements. Forge and all therein, together with all other moveable and unmoveables not mentioned in the above will.

I give and bequeath to my beloved wife Mary Bulger on the conditions named above, that she will remain unmarried if she should Marry all the residue mentioned above to be divided equally between my four Sons. David John Martin and Michael (the residue being as above) from the part marked with the cross. None of the above property or residue to be ever sold or mortgaged but always to remain in the Bulger family. If any Brother wishes to sell he is at liberty to do so to either of his brothers but not otherwise and I hereby appoint Peter Harvey and Edward Neary as Executors of this my last will and testament. And I do hereby utterly disallow revoke and disannul all and every other former testaments, wills legacies bequests and Executors by me in any way before named willed and bequeathed ratifying and confirming this and no other to be my last will and testament In witness whereof I have hereunto set my hand and seal the day and year above written Martin Bulger Signed sealed published and pronounced and declared by the said Martin Bulger as his last will and testament who at his request and in his presence and in the presence of each other have hereunto set our names as witnesses of the same Patrick Hanlon Philip his X mark Leamy

Codicile I hereby make this Codicile to my will made twenty-second day of August 1878 that I will & bequeath to my son David the meadow & land at the Whales back & to my son Martin the land & meadow at the gulchs and to my son Michael the Bridge Meadow the remainder of my property as stated in the said will to remain as stated) this ninth day July one thousand eight hundred & ninety Martin Bulger witness my hand This date W.H.
