To the Honourable the Supreme Court or to one of the Honourable the
Judges thereof.
The petition of Harold Wells, of Harbour Grace, in the Electoral
District of Harbour Grace, Labourer,
HUMBLY SHEWETH
1. John Peddle, late of Bristol's Hope, in the Electoral
District of Carbonear, Farmer, died at Harbour Grace aforesaid on
the 7th. day of August 1931, having previously published and
declared the paper writing hereto annexed marked "A" as and for
his last Will and Testament.
2. By his said Will the said deceased appointed your
Petitioner the executor thereof.
3. The said deceased left him surviving as next of kin, one
son, William, now residing at Everett, Massachusetts, U.S.A., one
brother, Martin Peddle, a sister, Mary Jane Warren, widow of the
late William Warren, and one niece, Marion Wells, wife of your
Petitioner, residing at Harbour Grace aforesaid.
4. The said deceased was the time of his death was possessed
of property within the jurisdiction of your Honourable Court of the
probable gross value of $1340.00, as appears from the hereunto
annexed inventory marked "B", which said inventory is a full, true
and correct account of the property and estate of the said deceased
so far your petitioner is aware or can ascertain.
5. No letters of probate of any will nor letters of adminis-
tration to the estate of the said deceased have been granted to
any person nor has anyone applied for the same other than your
Petitioner by this Petition.
  Your Petitioner therefore prays that your Honourable
Court or Lordship will be pleased to grant unto him Letters of
Probate of the Will and estate of the said deceased.
And as in duty bound he will ever pray etc.      Dated the 21st. day of August A.D. 1931.

I, John Casey, of Harbour Grace
in the Electoral District of Harbour Grace in the Island of Newfound-
land, Stipendary Justice make oath and say, that on the sixth day of
August A.D. One Thousand nine hundred and Thirty one
I was present and did see John Peddle ----------------------------------
late of Bristol's Hope, in the Electoral District of Carbonear
--------------------, in the Island aforesaid, Farmer ---- the Testator
named in the paper writing hereunto annexed, marked A., duly sign (by making his
mark), publish, and declare the said annexed paper writing, as and for his last Will and Testa-
ment in my presence, and in the presence of Arthur L. Rogers --------------.

the other subscribing witness    thereto.    That I and said Arthur L. Rogers

then and there signed our names to such Will as such witnesses, in the presence of the said Testator.
That previously to the Will being signed, as aforesaid, by the said testator and the said wit-
nesses, it was read over to, and approved of by, the said Testator in the presence of me and the
said Arthur L. Rogers ------------------------------
and that at the time of the said execution of the said Will, and the said Testator was of sound
and disposing mind, memory, and understanding, to the best of my knowledge and belief.

I, Harold Wells
  of Harbour Grace in the Electoral District of
Harbour Grace, Labourer, make oath and say that
John Peddle
late of Bristol's Hope, in the Electoral District of Carbonear
farmer, deceased died with a Will, that I am the Executor
---------- therein named; that I will well and faithfully administer the estate and
effects of the testator by paying his just debts and the legacies contained in
said Will----------------- so far as the same shall thereto extend and
the law bind me, and by distributing the residue (if any) of the said estate and effects
according to law; that I will exhibit under oath a true, full and perfect inventory of
all and singular the estate and effects of the testator, and render a just and
true account thereof whenever required by law so to do; that the testator died at
Harbour Grace, aforesaid -----------------------------------------------------
on the Seventh day of August ------------one thousand nine
hundred Thirty-one ; and that the gross value of the estate and effects
of the said testator is One Thousand Three Hundred
and forty 00/100 dollars, and no more, according to the best of my knowledge,
information and belief.

as deposed to be the last Will and Testament of John Peddle, the
Testator named in the said Will ????????????????

This is the last Will and Testament
of me John Peddle, of Bristol's Hope,
in the Electoral District of Carbonear,
in the Colony of Newfoundland.
I first order and direct that my
Testamentary and Funeral expenses, as well
as any lawful debts that I may owe be paid,
after which the following dispositions
shall be made of my estate:------------------
1. I give, devise and bequeath unto my niece
Marion Wells (wife of Harold Wells of Harbour Grace)
and to the said Harold Wells, all the money
I money I may possess at the time of my (initials JC beside strikeout)
death - either in Bank, or on hand, equally -----
2. I give, devise and bequeath unto the aforesaid
Harold Wells all the land, that I possess,
situate at Bristol's Hope, aforesaid, together
with the dwelling house, and all other erections
on the said land, and all other property, both
real and personal that I may possess at
the time of my death. -------------------------------
And I hereby nominate and appoint the
aforesaid Harold Wells as Executor of this,
my last Will and Testament. ------------------------
In Witness Whereof I have hereunto signed,
published and declared this, my last Will and
Testament at Harbour Grace, in the aforesaid
Colony, this Sixth day of August Anno Domini

Transcriber's Notes:

John Bellman Peddle was born in Mosquito (now Bristol's Hope), 24 July 1847. He was a son of Thomas Peddle and Martha Penny.

John first married Phoebe Seymour in Harbour Grace 20 February 1877. They had one son William Thomas Peddle born 27 Dec 1877. William is the son mentioned in this will. Unfortunately Phoebe died very soon after in January 1878 and John then married Sarah Jane Pike in Harbour Grace in December 1878. Sarah was a daughter of Moses Pike and Patience Cake. Sarah had a younger sister called Annie Liza Pike who married James Henry Alcock, son of James Alcock and Mary Ann French. Their daughter Marion May Alcock married Harold Wells.
John and Sarah had a son called John Pike Peddle born 27 February 1884 in Mosquito. At this time I have no history on this child.

William Thomas Peddle moved with his wife (Lillian Thistle, daughter of William and Sophia Thistle) and family to Everett, Massachusetts in 1915. In 1920, John and wife Sarah also moved to be with their son and his family and were recorded there in the 1930 US census. It would appear that Sarah may have died in the US (she died in May 1931) and John must have returned to Newfoundland after the 1930 census and before August of 1931.

Mary Jane born 15 Oct 1842 was the sister mentioned in the will. She married William Samuel Warren, a shipwright. William died in September 1924 and Mary Jane died nearly ten years later in February 1934. These were my great grandparents. Their daughter Gertrude married Ronald Martin and they were my grandparents.

I believe that Martin Peddle, the brother born circa 1852 also died sometime in the 1930s. Martin was first married to Patience Slade in January 1878. Their son also named Martin Peddle later married Mary Gregory and they moved to the Corner Brook area. After Patience died, Martin married a much younger woman Wilomena ?????. One of their children, John Martin Peddle died in Brigus 22 August 2005.
