IN RE: JOSEPH MURPHY. DECEASED
In the name of God Amen I Joseph Murphy of St. John's do make publish and declare this as and for my last will and testament
Firstly I will and direct that all my just debts funeral and testamentary expenses be paid as soon as possible after my death
Secondly To my daughter Ellen Brennan I give devise and bequeath the house on Le Merchant Road she now occupies free from all ground rent and the rent of the upstairs tenement of the flat roofed house adjoining the house now occupied by her to hold both properties during her natural life and after her death I give devise and bequeath the same to her children in equal shares and proportions.
Thirdly To my daughter Margaret Joy I give devise and bequeath the upstairs part of the house on LeMarchent Road now occupied by her to hold the same during her natural life and after her death I give devise and bequeath the same to her children in equal shares and proportions
Fourthly To my daughter Mary Joseph Penney I give devise and bequeath the downstairs part of the house on Le Marchent Road now occupied by her and me together with all the household furniture goods and effects therein to hold the same during her natural life and after her death I give devise and bequeath the same to her children in equal shares and proportions.
Fifthly I give devise and bequeath the remaining twenty-one tenements situate on Le Marchent Road to my executor hereinafter named in trust to collect the rents and profits therefrom and after paying all taxes and charges thereon to divide the balance equally between and the same equally to pay to each of my said three daughters Ellen Brennan Margaret Joy and Mary Joseph Penney during their lives and in the event of any or all of them dying leaving lawful issue to pay the share of such rents equally amongst the children of the daughter so dying so that the children of each shall receive their parents share and upon the death of the last surviving of my said daughters to transfer the said properties equally to the children of my said daughters so that the children of each will receive their parents share
Sixthly I will and direct that from and out of the rents of said tenements there shall be paid for all time to come sufficient money to the Archbishop of St. John's for the time being to cause to be said annually four masses - two for the repose of my own soul and two for the repose of the soul of my wife Margaret Murphy.
Seventhly I will and direct that my land on the Thorburn Road near St. John's be divided into three equal parts and I give devise and bequeath each of the said parts as follows to my daughter Ellen Brennan the part nearest town the centre part to my daughter Mary Joseph Penney and to my daughter Margaret Joy the part furthest from town each of my said daughters to hold her part for her natural life without power to cell or mortgage the same and after the death of each her part is to be divided equally amongst her children and in the event of any of my said daughters dying without leaving issue the share of the daughter so dying to be divided equally amongst my grandchildren
Eighthly All the rest residue and remainder of my moneys goods and effects I give devise and bequeath to my said daughters equally to be divided between them to hold the same for life and on the death of any of my said daughters I give devise and bequeath her share thereof equally to her children
ninthly I hereby nominate and appoint Michael Murphy of St. John's Cooper to be the executor of this my will
Tenthly I hereby revoke all other and former wills by me made. - Joseph his x mark Murphy - Signed published and declared by the said testator as and for his last will and testament in our presence who in his presence and at his request and in the presence of each other have hereunto subscribed our hands as witnesses at St. John's this day of September 1910 the same having been first read over and explained to the said testator who approved thereof.
