IN RE: JOHN MAUNDER. DECEASED
This is the last will and testament of me John Maunder of Saint John's Tailor.
1. I appoint Arthur C. Peters of saint John's Commission Merchant and my son Ernest Maunder executors of this my will.
2. I give devise and bequeath all the stock-in-trade, bookdebts, fixtures, fittings, machinery and all other assets of the tailoring business carried on by me at Saint John's including the goodwill thereof and the freehold building and premises in which the said business is carried on and all cash on hand or in bank on current account of the said business (but not any moneys on Savings Account) to my sons Ernest Maunder and Ralph Maunder in equal shares absolutely, and forever but subject to all the liabilities of the said business.
3. I also give my country house and land to my said sons Ralph Maunder and Ernest Maunder in equal shares forever.
4. I also give to my son Ernest Maunder the land and dwelling house situate on Forest Road which he occupies, forever.
5. I direct that my wife shall have the use of the dwelling house situate on Forest Road which I occupy, with all the furniture and effects therein, during her life: and on her death I give devise and bequeath the said dwelling house and furniture to my son Ralph Maunder and my daughter Beatrice Maunder in equal shares forever.
6. I direct my executors to invest the rest residue and remainder of my moneys property and estate of every description or the proceeds thereof (including all moneys in Bank on Savings Account) and to pay the income thereof to my wife during her life for the maintenance of herself and my daughter Beatrice and my sister Lilian Maunder.
7. On the death of my said wife I give and bequeath one half of the said residue of my estate to my said daughter Beatrice: One sixth thereof to my daughter Amy Neal: my executors shall retain the remaining one third of the said residue and pay the income thereof to my daughter Eleanor Mawer during her life: on the death of the said Eleanor Mawer the said one third of the residue shall go to her children (if any) then living, in equal shares; but if there be no children of the said Eleanor mawer then living, to all my children then living in equal shares. PROVIDED however that if on the death of my said wife my said sister shall still be living my executors shall if they consider it necessary make provision for the maintenance of my said sister during her life out of the said residue or the income thereof and in such case they may apply or postpone the distribution of so much of the said residue as may be necessary for that purpose in their discretion until the death of the said Lilian Maunder. I give and bequeath to my grand-daughter Margaret Maunder the sum of two thousand dollars to be taken out of my business and the bequest of the said business to my said sons Ernest and Ralph shall be subject to this bequest. The said sum or any part thereof may be applied by my executors in their discretion for the education and support of my said grand-daughter during her minority.
