In re
            John Boggan deceased.

In the name of God Amen.     I John Boggan of Saint John’s Cooper being of sound mind memory and understanding do make and publish the following as and for my last will and testament     To my executors hereinafter named I will and bequeath all that farm of land buildings and erections thereon situate and being on the south side of Pennywell Road and also all the land dwelling houses and appurtenances purchased by me from Popes Estate and situate on the western side of Waldergrave Street in St. John’s to have and to hold the same unto my executors in trust for the use and benefit of my daughter Margaret widow of the late George Branscomb and her two daughters Georgina and Margaret and I hereby impose on said lands tenements and premises as a rent charge for all time to come the sum of four pounds to be paid annually by my executors in manner following- that is to say two pounds to the Convent of Mercy Military Road and two pounds to the Roman Catholic Bishop of St. John’s for the celebration of Masses for the repose of my soul and the souls of my deceased wife, father and mother.     On the death of either of my said grand daughters without issue the share or interest of such one so dying shall go to the survivor and on the death of both without issue then their shares shall go to and be divided among all of my children share and share alike

To my son James I will and bequeath that land and dwelling house and premises situate in Gower Street and to the eastward of the dwelling house now occupied by me to be held by him for ever subject to the rental charge of three pounds per annum to be paid by him to the Superioress for the time being of the Convent of Mercy Military Road, St. John’s.

To my said daughter Margaret I will and bequeath the land and dwelling house now occupied by me.     All my household furniture I will and bequeath in equal portions to my son James and my daughter Margaret.

To my sons John, Richard and James I will and bequeath all that farm of land situate on the north side of the Freshwater Road in the District of St. John’s also all my lands and tenements situate and being on Longs Hill and all my right title and interest in that land and tenements lying and being to the southward of the Star of the Sea Hall and abutted on Duckworth St to have and to hold the same by my said sons as tenants in common share and share alike-

I     will and bequeath to my son James all my right title and interest in and to the land on which my cooperage stands and an erection now thereon and my stock in trade and all my tools and implements- and also to my son James and my daughter Margaret all other leasehold lands and tenements held by me under lease from the executors of the late Patrick Doyle to hold the same share and share alike as tenants in common subject to the further rent charge which I hereby impose thereon of three pounds per annum to be paid by them to the Orphanage of St. Michael’s Belvedere.

I will direct and desire that my son James and daughter Margaret shall and will support maintain and cloth my wife during her life and on her demise defray all expenses incurred in and about her burial and the expense and costs of such maintenance and burial I impose as an additional charge on the lands tenements and premises herein before bequeathed to them-

I desire my executors to cause a High Mass to be celebrated for the repose of my soul-     I will and bequeath the sum of six pounds per year to the St. Vincent de Paul Society of St. John’s to be paid by my said daughter Margaret and my son James and I impose such amount as a rental charge on the lands, tenements and premises herein bequeathed by me to them and each of them.

All the rest residue and remainder of my lands moneys securities chattels and effects I will and bequeath to my children in even and equal portions hereby revoking cancelling and annulling all other wills made by me-     I hereby nominate and appoint Laurence Barron and Austin McNamara executors to this my last will and testament-     Signed sealed and declared by me this 21st day of February A.D. 1880.     John Boggan.     Signed and declared in our presence J.I. Saint John’s May 17th 1882.     As a codicil to the within and foregoing last will and testament I John Boggan further will and bequeath the sum of ten pounds currency to His Lordship the Most Reverend Dr. Power Bishop of Saint John’s for the celebration of Masses for the repose of my soul- also to each one of the Catholic priests of Saint John’s, Portugal Cove, Tor Bay and Witless Bay, I will and bequeath five pounds for the like purpose and object-
To the Benevolent Irish Society of St. John’s I will and bequeath twenty-two shares of the forty-two I hold in their Building Fund-     I hereby ratify and confirm my said will in all other particulars and declare this to be a part thereof-
To the Very Reverend Jeremiah O’Donnell and the Reverend Patrick O’Donnell of Harbor Main Parish I will and bequeath five pounds each for Masses.     John Boggan.     Witness J.I. Little, R.J. Kent.

I John Boggan of Saint John’s, Cooper, having made my last will and testament on the twenty-first day of February eighteen hundred and eighty (1880) and executed a codicil thereto on the seventeenth day of May 1882 do hereby make and execute the following as a further codicil and declaration of my intentions and wishes in reference to the application of my chattels property and effects:     I will and direct and the bequests in my said will are made and given upon the express condition and charge that in the event of either of my said children named as legatees in said will attempting to charge by way of sale or mortgage any portion of my lands or any interest bequeathed to him or her therein such legacy or interest shall become forfeited and form part of the residue of my estate.
I will and bequeath the sum of fifty pounds to be applied towards the completion of St. Patrick’s Church at River Head in St. John’s.
I will and bequeath twenty-five pounds £25 to each of the Societies of St. Vincent de Paul in St. John’s.     In all other respects and particulars I hereby ratify and confirm my said will and codicil and declare this to be a part thereof.     John Boggan.     Signed and declared this 9th June 1883 in presence of J.
