Will of Joanna Keating

In re JOANNA KEATING: DECEASED.

This is the last will of me Joanna Keating of St. John*s Newfoundland Spinster I give devise and bequeath all my estate and effects real and personal of what nature and kind soever and wheresoever situated to my executors hereinafter named and their heirs upon trust to apply and appropriate the same as follows, that is to say, after payment of my just debts and funeral expenses upon trust during the natural life of my sister Charlotte Keating to pay and appropriate the annual rents interest issues and profits of all my said estate and effects to and for her sole use and benefit and after her decease upon the trusts following,

First, upon the trust during the natural life of my niece Mary Ann White of Stamford in England, Widow, of John Chamberlain White, to pay and appropriate the rents issues and profits of all my share of and in the property in St. John*s held under lease by Mrs. Hoyles and known as Sudbury Hall, and one third of the annual interest of my monies and personal effects, to the sole use and benefit of my said niece Mary Ann White; and after her decease upon trust to assign and convey the said Sudbury Hall and to pay one third of my personal effect and monies to and amongst the children of the said Mary Ann White (share and share alike and children of a deceased child to represent their deceased parent)

Secondly, Upon the trust to pay and appropriate to the sole & separate use of my niece Catherine Theresa Tayles wife of Frederick A. Tayles of Lincoln in England during the term of her natural life the rents issues and profits of all my share of and in the property in St. John*s now under lease to Charles Fox Bennett Esq. And known as Woodbine Place and also one third of the annual interest of my monies and personal effects and after the decease of my said niece Catherine Theresa Tayles upon trust to convey and assign the said Woodbine property and to pay one third of my personal effects and monies to and amongst the children of the said Catherine Theresa Tayles (share and share alike and children of a deceased child to represent their deceased parent)

Thirdly Upon the trust to pay and appropriate to the use of my nephew William Henry Herard Latam during the term of his natural life the rents issues and profits of the property in Water Street in St. John*s now under lease to John Blundon and John Cantwell and also one third of the annual interest of my monies and personal effects; and after the decease of my said nephew upon trust to assign and convey the said Water Street property and to pay one third of my personal effects and monies to and amongst the legitimate children of my said nephew (share and share alike and children of a deceased child to represent their deceased parent)     In the event however of my said nephew not leaving at his decease legitimate children or grandchildren him surviving I will and direct that the moneys property and effects hereinbefore bequeathed to him for life shall then be distributed one half to the children of my said niece Mary Ann White share and share alike with representation as aforesaid and one half thereof to the children of my said niece Catherine Theresa Tayles share and share alike with representation as aforesaid.     I appoint my friends Walter Grieve and Francis E.R. Hepburn Esqrs and Mr. Pierce Feehan, executors of this my will.
