In re JOANNA HYNES. DECEASED. This name is spelled Joanna and Johanna in the will and Joanna in the will index.This is the last will and testament of me Joanna Hynes of St. John’s in the Island of Newfoundland Spinster I will devise and bequeath to my sister Anne Driscoll wife of Michael Driscoll of Mobile all my houses and property situate on the Military Road in St. John’s aforesaid and also all and singular the houses gardens fishing rooms lands premises and all other property situate in Witless Bay in the Southern District of the said island bequeathed to me by the late Mr. Thomas Avery and also all monies invested or otherwise belonging to me and now in the Newfoundland Savings Bank, Commercial Bank of Newfoundland and the General Water Company or any other Bank or Company whatsoever and the scrips certificates or other documents representing such monies or investments- All and singular the said bequests to my said sister are to be taken and held by her as separate estate free and clear of the debts liabilities and control of her said husband and of every other person whomsoever but under and subject nevertheless to certain directions which I have given to the Reverend Michael O’Driscoll of Witless Bay Roman Catholic Priest and which directions I have requested him to convey to my said sister. It is my will and desire that my said sister shall by will or otherwise give or bequeath the property herein bequeathed to her to and amongst her children in such proportions and in such manner as she shall think proper. I do hereby nominate constitute and appoint the Very Reverend John Scott of St. John’s aforesaid Roman Catholic Priest and Joseph I. Little of same place Barrister at law executors of this my last will and testament and do hereby revoke annul and declare void all wills by me heretofore made. Witness my hand at St. John’s aforesaid this 28th day of February Anno Domini one thousand eight hundred and seventy six.
