Will of Jeffery Lash

In re: JEFFERY LASH DECEASED.

This is the last will and testament of me Jeffery Lash formerly of Saint John’s Newfoundland Merchant but now residing at Avalon Villa Paignton in the County of Devon Gentleman I appoint my sister-in-law Marianne Lash to be executrix and my cousin Augustus Frederick Goodridge of Saint John’s Newfoundland and my friend James Baird Senior also of Saint John’s Newfoundland to be executors of this my will and I appoint the said Augustus Frederick Goodridge and James Baird hereinafter called "my trustees" to be Trustees of this my will I direct all my just debts funeral and testamentary expenses and also the legacies bequeathed by this my will or any codicil hereto to be paid off and discharged as soon as conveniently may be after my decease-

I give devise and bequeath unto my sister Catherine Goodridge Caldwell widow of the late James Caldwell residing in Melbourne Australia the sum of two hundred pounds absolutely but should my said sister die before my decease I give devise and bequeath the same unto her daughter absolutely
I give devise and bequeath unto my sister Mary Grace Haddon the wife of William Haddon residing at Chelston Terrace Torquay in the said county of Devon the sum of two hundred pounds absolutely and should this my said sister die before my decease I give devise and bequeath the same unto Mary Louisa Haddon Catherine Grace Roberts wife of the late Ogelvie Roberts Margaret Ann Haddon and Emma Caroline Haddon daughters of my said sister Mary Grace Haddon in equal shares as tenants in common
I give devise and bequeath unto my niece Agnes Goodridge Towell the sum of fifty pounds absolutely
I give devise and bequeath unto John Lash son of my brother Frederick Lash one hundred pounds absolutely
I give devise and bequeath unto my niece Grace Lash sister of the above named John lash fifty pounds absolutely and I give devise and bequeath unto my trustees the sum of twenty five pounds each as some recognition for their services and the trouble they will be put to in the execution of the trusts of this my will and I direct and it is my wish that the above mentioned legacies and debts be paid and discharged out of my Bank shares which I have in the Commercial Bank Newfoundland and the shares which I have in the Steam Tug Company in Newfoundland

All the rest residue and remainder of my estate both real and personal of whatever kind and wheresoever situate I give devise and bequeath unto my Trustees upon trust to pay the annual income thereof to my said sister-in-law Marianne Lash during her life and from and after her decease in trust for her four sons Jeffery Frederick, Mortimer George, George Richard Page and William Herbert or any child or children of such of her said four sons who may die in her lifetime the objects of this trust to take in equal shares as tenants in common and not as joint tenants except that the child or children of any deceased son of the said Marianne Lash shall take the share only which his her or their parent would have taken if he had survived his mother the said Marianne Lash
And it is my wish that if my Trustees find it necessary to employ an agent or attorney to collect the rents and dividends of any of my property in Newfoundland or generally to manage the same that they do employ Sir William Vallance Whiteway of Saint John’s Newfoundland (who has for some time past faithfully and conscientiously performed the duties of agent and attorney for me) their agent or attorney And hereby revoking all former wills at any time heretofore made by me I declare this to be my last will and testament In witness whereof I have hereunto set my hand the second day of February one thousand eight hundred and eighty five. Jeffery Lash. Signed by the above named Jeffery Lash the testator as and for his last will and testament in the presence of us both being present at the same time who at his request and in his presence and in the presence of each other have hereunto subscribed our names as witnesses, Chas. D. Willis Naval Bank, Paignton, Manager. Chas. H. Eastley Solicitor, Paignton Devon.

This is a codicil to the within written last will and testament of me Jeffery Lash I give devise and bequeath unto my nephew William Herbert Lash my share in the Atheneum Building St. John’s Newfoundland and in all other respects I confirm my said will In witness whereof I have hereunto set my hand this fifth day of February one thousand eight hundred and eighty five. Jeffery Lash. Signed by the said Jeffery Lash the testator as and for a codicil to his last will and testament in the presence of us both being present at the same time who at his request and in his presence and in the presence of each other have subscribed our names as witnesses the word "Howard" in the third line having been first struck out and "Herbert" inserted.
