In re: JAMES R. MOSS. DECEASED
This is the Last will and Testament of me James Robert Moss of St. John's, Newfoundland, Master Mariner:-
1 I revoke all former wills and testamentary dispositions by me at any time heretofore made.
2. I appoint my friends the Honourable Robert K. Bishop of St. John's, Merchant, and Arthur C Peters of St. John's, Accountant, Executors and Trustees of this my will.
3 I order that my just debts and funeral and testamentary expenses be paid out of my estate.
4 All the moneys banked or invested in the joint names of my wife and myself I leave unto my said wife absolutely.
5 All my household furniture and effects I leave to my wife absolutely.
6 All the rest residue and remainder of my estate I will desire and bequeath unto my executors and trustees aforesaid to hold the same upon the following trusts, namely, to pay the whole of the income rents issue and profits thereof unto my wife during her lifetime or so long as she shall remain unmarried but I declare that during the lifetime or widowhood of my said wife as aforesaid neither my executors nor my said wife shall have any power to sell or mortgage any of the said rest residue and remainder of my estate dealt with in this paragraph of my will. After the death or remarriage of my wife my executors aforesaid shall hold the said rest residue and remainder of my estate upon the following trusts, namely.
To pay to Mrs. Lily Light and Mrs. Olive England, both of Brisham in Devonshire, England, the sum of two hundred and fifty dollars each; to pay to Richard Bransfield of London in England two hundred and fifty dollars and to pay to James Robert Moss Baggs Bay of Islands two hundred and fifty dollars; to hold the house and land on Cook Street in St. John's and now in the occupancy of Benjamin Keeping and to deal with the same according to the terms of the agreement existing with him to hold the leasehold houses numbers 34 and 36 Bond Street in St. John's to the use of the Gower Street Methodist Fund for the poor and after paying ground rent taxes insurance premiums and costs of repair and other necessary disbursements in respect thereof to distribute the annual rents or income thereof amongst six female pensioners not being under the age of sixty-five years so as to give them from sixty cents to one dollar per month each. In the event of these houses being sold or burnt down the purchase money or insurance money received shall be deposited in the Newfoundland Savings Bank and the interest thereof applied in the same manner as I have directed that the rents or income aforesaid should be applied;
To hold the freehold land and the house thereon known as 197 Gower Street in St. John's to the use of the Gower Street Methodist Church in St. John's to the intent that it be employed as the parsonage of the said Gower Street Methodist Church for ever and to be used for no other purpose whatsoever. In the event of the said house being at any time burnt down I desire that an effect shall be made to purchase the land owned by the Sclater family adjacent to the land in which the said house 197 Gower Street is built and that upon the land covered by the said 197 Gower Street and upon the land as purchased from the Sclater family or their assigns a single detached house be erected which house shall be used as a parsonage for the said Gower Street Methodist Church for ever and for no other purpose whatsoever. Should it be impossible or inexpedient to purchase the said land owned by the Sclater family the parsonage house shall be rebuilt on the land now covered by 197 Gower Street and it shall be used as a parsonage for the said Gower Street Methodist Church for ever and for no other purpose whatsoever. The insurance moneys received in the event of the building now existing being burnt down shall be applied to the rebuilding aforesaid.
To hold and deposit the interest falling due under the mortgage upon the present Gower Street Methodist parsonage as well as the principal thereof when it shall be repaid in the Newfoundland Savings Bank and to use the same as well as all interest accruing therefrom for the necessary purposes of the parsonage herein bequeathed as they shall from time to time arise:
To hold six five hundred dollar debentures of the Colony of Newfoundland and to pay the half yearly interest arising therefrom to Bessie M Barnmand a spinster and a deformed woman of 132 Arrow Street Castle Road Cardiff during her lifetime and after the death of the said Bessie M Barnmand to pay the said half yearly interest thereon unto and to the use of the Methodist Orphanage of St. John's, Newfoundland:
to hold two five hundred dollar debentures of the said Colony and to pay the same unto and to the use of the Gower Street Methodist Church building fund:
to hold four five hundred dollar debentures of the said Colony together with the accruing interest thereon (which latter shall be deposited in the Newfoundland Savings Bank) and to pay the same from time to time as money shall be needed for the purposes of the Methodist Parsonage by this will bequeathed:
To hold the debenture No. 721 for one thousand dollars and to pay the same to the Trustees of the Methodist Church at Carbonear who shall use the interest thereof for the benefit of the poor of the said church particularly females;
To hold any portion of the said rest residue and remainder of my property after the death or remarriage of my said wife not herein specifically disposed of unto the use of the Trustees of the Gower Street Methodist Church And I direct that all landed properties belonging to my estate be kept insured by my said executors and trustees. And I pray that the blessing of God may rest upon all the bequests made in this my will
