Will of James Harvey

In re: REV. JAMES CHARLES HARVEY. DECEASED.

This is the last will and testament of me James Charles Harvey formerly of Port de Grave but now of St. John’s Clerk in Holy Orders. I hereby revoke all former and other wills at any time made by me and declare this to be my true last will and testament. I will and bequeath the interest upon all the property consisting of Bank shares, Government Debentures and other investments whatsoever and all my personal effects unto my wife Amelia Harvey and my daughter Amelia Bertha Harvey share and share alike subject to the contingencies hereinafter set forth. Should my said wife die than the whole interest upon my said investments shall become the property of my said daughter Amelia Bertha during her life or spinsterhood. Should my said daughter Amelia Bertha die or marry the said interest shall become the property for life of my said wife, provided she shall survive my said daughter. And upon the death of my said wife and of the death or marriage of my said daughter Amelia Bertha the whole interest in my said estate shall become the property of my children who shall be surviving at the happening of the last event and to the children of my children who shall have predeceased me. It is my wish and desire that none of my investments shall be disturbed or realized unless circumstances should compel such action. I appoint Harrison R. Hayward and William H. Horwood executors of this my last will and I desire that they shall invest to the best advantage for the benefit of my said legatees all monies conveying from my life insurance policies.

Signed published and declared by the said testator as and for his last will and testament in the presence of us who in his presence and in the presence of each other have hereunto subscribed our names as witnesses at Saint John’s Newfoundland this 15 day of July AD 1892.

James Charles Harvey at present of Windsor in the County of Hants and province of Nova Scotia Clerk in Holy Orders do make this codicil to my last will and testament which will is dated the 15 day of July AD. 1892 and is aforewritten. I hereby revoke and cancel the last clause of said will appointing executors thereto and substitute the following. I hereby constitute and appoint my wife Amelia Harvey executrix and my friend William Carson Job of the City of St. John’s in the province of Newfoundland Merchant executor of this my last will and testament and I hereby confirm the said will except as revoked and modified by this codicil.

In witness whereof I have hereto affixed my hand & seal the eighteenth day of January in the year of our Lord one thousand eight hundred and ninety five.
