Will of Henry Thomas

In re: HENRY THOMAS DECEASED.

The will index gives the probate year, for this will, as 1879, but it is filed chronologically with wills from 1886.

This is the last will and testament of me Henry Thomas of St. John’s, Farmer.

First- I give devise and bequeath to my daughter Sarah Jane Jocelyn wife of James Jocelyn of Antigonish the sum of forty five pounds currency for her own separate use and benefit- to will and dispose of as she may deem fit and free from the control of her present or future husband-

Second- I give devise and bequeath to each of my grand-daughters viz: Mary Grace Irving and Jessie Cash the sum of ten pounds currency for their own separate use and benefit to dispose of as they may think proper and free from the control of their present or future husband-

Third- I give devise and bequeath all the residue and remainder of my property monies and effects of whatsoever kind and wheresoever situate to my two sons Matthew Thomas and Edward Thomas their and each of their executors administrators and assigns equally between them share and share alike but the said bequest to my son Edward is on the express condition that the sum of fifty pounds currency and interest which he now owes me is to be deducted out of his said share if not paid at the time of my decease which said fifty pounds and interest is to form part and parcel of my general estate

Fourth- I hereby appoint my son Matthew Thomas of St. John’s Yeoman, sole executor of this my last will and testament- In witness whereof I have to this my last will and testament subscribed and set my hand by affixing my mark hereto at St. John’s in the Island of Newfoundland this twenty seventh day of August Anno Domini one thousand eight hundred and seventy-nine- Henry his X mark Thomas. Signed and acknowledged by the said testator Henry Thomas as and for his last will and testament in writing in the presence of us at his request and in the presence of each other all being present together at the same time have hereunto subscribed our names as witnesses the same having been first read over and explained to the said Henry Thomas, Augustus O. Hayward, J. Augustus Clift.
