Will of Henry Hiscock

In re: HENRY HISCOCK DECEASED

This is The last will and Testament of me Henry Hiscock of St. John’s Boilermaker.

First. I appoint Thomas A. Pippy of St. John’s Machinist and Peter N. Skirving of the same place, Draper (hereinafter called "my trustees") to be Executors and Trustees of this my will.

Second. I direct that all my just debts funeral and testamentary expenses be first paid out of my estate

Third I give and bequeath all my household furniture goods wares chattels and effects unto my wife Susan Hiscock absolutely.

Fourth I give and bequeath all my stock in trade goods wares -------- merchandise chattels and effects which may be in the shop owned by me on Pleasant Street or elsewhere at the time of my death unto my said wife absolutely

Fifth. I give devise and bequeath all my property not hereby otherwise disposed of unto my trustees Upon Trust to pay the net income thereof after paying for such repairs and works as may in their opinion be necessary to maintain any real property in a reasonable state of repair and after paying all other outgoings connected therewith, to my said wife during her life or until she shall marry again. Provided that if in the opinion of my trustees the said net income arising from same should at any time or times be insufficient for the support and the maintenance of my said wife in comfort as she has been accustomed to living with me that my trustees shall pay to my said wife out of the body or principal of my estate such sum or sums as shall be sufficient in their discretion when added to the net income arising from my estate to maintain and support my said wife as aforesaid so only that the total sum paid to her out of my estate shall not exceed the sum of Four hundred dollars And should my said wife marry again I give devise and bequeath all the property mentioned in paragraph five of this my will or such part thereof as shall then remain unto my trustees In Trust to assign and convey to my said wife absolutely the messuage and premises used by me as a residence situate on Pleasant Street, and as to the residue of my property upon Trust for such of the children of my daughter Maria Campbell as shall then be living share and share alike and should my said wife die without remarrying I give devise and bequeath all the property mentioned in paragraph five of this my will or such part thereof as shall then remain unto my trustees Upon Trust for the sole use and benefit of such of the children of my said daughter Maria Campbell as shall then be living share and share alike

And I hereby declare that it shall be lawful for my trustees at their absolute discretion at any time or times to sell all or any part or parts of the property mentioned in paragraph five of this my will and to invest and hold the proceeds of such sale or sales upon the same trust or trusts as the said property would be held upon by them if there were no such sale or sales and I further declare that my trustees may invest any moneys liable to be invested under this my will in any security authorized by law or upon the security of any freehold or leasehold property within the Colony of Newfoundland.

In witness whereof I the said Henry Hiscock have hereunto set my hand at St. John’s aforesaid this twenty-ninth day of January anno Domini one thousand nine hundred and nine. Henry Hiscock. Signed by the said testator as and for his last will and Testament in the presence of us both being present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses.
