This is the last will and testament of George Palk of Saint John’s in the Island of Newfoundland, Farmer.     In the first place I will and bequeath all and singular my household furniture and personal property to my dear wife Johanna.     In the second place I will and bequeath all and singular my lands tenements and hereditaments whether situate in Newfoundland or elsewhere to my said wife Johanna to her sole use and benefit for and during the term of her natural life     In the third place it is my will that after the decease of my said wife Johanna all my lands tenements and hereditaments (except the dwelling house now in course of erection on the north side of Water Street between Thomas Byrne’s house on the west and my house also in course of erection on the east) shall be divided amongst my children John, Eliza and Jane in such proportions as my said wife Johanna may think proper and in case she should die not having made a will then the whole shall be divided equally amongst the said John, Eliza and Jane or their heirs.     In the fourth place I will and bequeath (after the decease of my said wife Johanna all that dwelling house before excepted situate on the north side of Water Street between Thomas Byrne’s house on the west and my house in course of erection on the east, which said house is now in course of erection to my daughter Mary Ann Harvey to her sole use and benefit and her heirs independent of her present or any future husband and in case the said Mary Ann Harvey shall die before she my said wife then I will and bequeath the said house last described to the children of the said Mary Ann Harvey after the decease of my said wife Johanna.     And moreover it is my will that all my just debts be paid out of the personal property so bequeathed as aforesaid to my wife Johanna-     And lastly I do hereby appoint my said wife Johanna sole executrix of this my last will and testament.     In witness whereof I have hereunto set my hand and seal at Saint John’s aforesaid this twentieth day of May Anno Domini eighteen hundred and fifty one.     George Palk (LS)     Signed sealed and declared in presence of Jonas Barter, W.V.
