In re: GEORGE O’REILLY. DECEASED.
In the name of God Amen. I George O’Reilly of No. 33 Barnes Road St. John’s do make publish and declare this as and for my last will and testament.
First I will and direct that all my just debts funeral and testamentary expenses be paid as soon as possible after my death.
Second I give devise and bequeath all my property goods and effects of every nature and kind to my wife Mary Ellen O’Reilly to hold the same during the period of her natural life or until she marry again if she should do so.
Third On the death of my wife or upon her marrying again I give devise and bequeath as follows:- - (1) To my niece Rose McKenzie wife of James A. McKenzie all my freehold and unencumbered land and property situate on and being numbered 31 and 33 Barnes Road St. John’s and occupied respectively by Thomas J. O’Mara and myself
- (2) To my nephew George O’Reilly son of Patrick J. O’Reilly all that portion of my land at Butter Point Jersey Side Placentia which was left to me by my Father the late Patrick O’Reilly
- (3) To my said niece Rose McKenzie I give all that portion of my land at Butter Point Jersey Side Placentia which I bought from my brother John J. O’Reilly.
- (4) To my nephew Thomas O’Reilly son of Patrick J. O’Reilly all my land situate at Larkin Pond Jersey Side Placentia
- (5) To my nephews George O’Reilly and Thomas O’Reilly sons of Patrick J. O’Reilly all my right title and interest in and to that property being No. 124 Water Street St. John’s occupied by P.J. O’Reilly and formerly the property of my father the late Patrick O’Reilly
- (6) To the Archbishop of St. John’s and his successors in office a debenture of the colony of Newfoundland for ($500.00) Five hundred dollars to hold the same in trust to apply the interest received therefrom yearly and every year for the celebration of low Masses for the repose of my soul and the souls of my wife Mary Ellen O’Reilly my father and mother and my niece Rose McKenzie and the event of those named not needing the same then for the repose of the souls of such of my family as may be most in need thereof
- (7) To the Orphanage Belvidere the sum of Two hundred and fifty dollars for the benefit of the orphans
- (8) To Mount Cashel School of Industry the sum of two hundred and fifty dollars for the benefit of the orphans
- (9) All the rest residue and remainder of every kind of property goods and effects I give to my niece Rose McKenzie
- (1) To my niece Mary Billingsby wife of W. Billingsby I give the sum of five hundred dollars.
- (11) All the bequests above given to my niece Rose McKenzie namely those numbered (1) (3) and (9) are subject to the following conditions and limitations namely that in the event of the death of the said Rose McKenzie leaving a child or children her surviving the same shall thereupon be and become the property of the said child or children but in the event of the said Rose McKenzie dying without leaving a child surviving her then the same shall be divided equally between the then surviving male children of my brother Patrick J. O’Reilly and shall thereupon be and become the property of such male children equally.
Fourth I hereby nominate and appoint James Davis of Job Brothers & Co. to be the executor of this my will and I hereby bequeath to the said James Davis the sum of one hundred and twenty five dollars as remuneration for his work as executor. George O’Reilly. Signed published and declared by the said testator in our presence who in his presence at his request and in the presence of each other have hereto subscribed our hands as witnesses at St. John’s this 24th day of September 1914, J.
