In re: GEORGE HENRY EMERSON . DECEASED.
This is the last will and testament of me George H. Emerson, Judge of the Supreme Court of Newfoundland. I revoke all former wills made by me.
First I give devise and bequeath to my son Edward all my law books as compensation for his executorship of this my will.
Secondly. I confirm the gift of my gold watch to my son Prescott.
Thirdly. I give devise and bequeath all the rest residue and remainder of my estate, of whatever nature or kind, to my wife Katherine Mary, during her natural life and after her death to such of my children then living and in such proportions as she shall, in her last will and testament or other formal instrument executed during her lifetime appoint: and in the absence of the exercise of such power of appointment then all my children then living share and share alike.
Fourthly I appoint my wife Katherine Mary and my son Edward executors of this my last will and testament. Dated at St. John’s, Newfoundland, this ninth day of January, One thousand nine hundred and thirteen. Geo. H. Emerson. Signed, published and declared by the said testator as his last will and testament in our presence who, in his presence and in the presence of each other, have subscribed our names as witnesses to the due execution thereof on the day and date thereof.
