Will of George Byles

In re: GEORGE BYLES. DECEASED

In the name of God Amen I George Byles of St. John’s Farmer do make publish and declare this as and for my last will and testament

First I will and direct that all my just debts funeral and testamentary expenses shall be paid as soon as possible after my decease.

Secondly I will and direct as follows. If I should die before my youngest son George William Byles I give to him part of my farm bounded by the Bay Bulls Road near St. John’s this part shall extend in the rear to a brook or stream of water that runs across the farm, this shall be his bounds in the rear. I also give and bequeath to the said George William Byles all and every moveable article including cart and all farm and other instruments and every thing of every nature or kind on the said farm and all cattle and poultry thereon, together with the two buildings on the said farm and all their contents furniture bedding and all things both inside and outside the said house shall be his.

And the said George William Byles shall be liable to pay all debts due by me at the time of my death and to receive all moneys then due to me and he shall pay to his three sisters and one brother the sum of twenty dollars the names of his said sisters and brother shall be Elizabeth Hynes Benjamin Tapp Byles Martha Benson and Charlotte Chafe, these shall have the said twenty dollars each from this farm and they shall claim no more. And all my interest in and to that piece of land situate on Shotts Road shall be sold after my death and the money the proceeds thereof shall be divided in equal shares amongst the said last mentioned four.

Now I give the rear and back part of my farm to my second son Henry Thomas Byles and his bounds shall be the aforesaid brook or stream of water, which runs across the farm the said Henry Thomas Byles shall not sell or mortgage this portion of the farm without the consent of his brother George William And the said Henry Thomas Byles shall have a piece of building ground, this ground shall be situate on the south side of the entrance gate from the Bay Bulls Road and this land shall measure thirty feet wide and one hundred feet long and the said Henry Thomas Byles shall have a right of way to go to his property through George Williams part.

And I hereby nominate and appoint my said son George William Byles to be the executor of this my will Witness my hand at St. John’s this 25th day of June A.D. 1896 George his X mark Byles Signed published and Declared by the said George Byles as his last will and testament in our presence who in his presence and at his request and in the presence of each other have hereto set our hands as witness on the said date This will having been first read over and carefully explained to the said George Byles James M Kent Daniel F Kent
