Will of Frederick Chafe

In re: FREDERICK CHAFE DECEASED.

This is the last Will and Testament of me, Frederick Chafe, of The Goulds in the District of St. John’s, West, Farmer:

FIRST: I hereby revoke all previous Wills and testamentary dispositions heretofore made by me.

SECOND: I appoint my daughter Mary Jane Chafe and Brian E. S. Dunfield of St. John’s Barrister to be the executors of this my last Will and Testament.

THIRD: I give and bequeath to my daughter Mary Jane Chafe absolutely that part of my farm at the Goulds held under Grant from the Crown numbered 2121 and dated August 29th A. D. 1865 and also my house and land on Plymouth Road, Holyestown, St. John’s.

FOURTH: I give and bequeath to my said executors all the residue of my property real and personal of every kind whatsoever whereof I may die possessed to held by them as it is at present or leased or sold and disposed of or dealt with in any other way which to my said executors shall seem expedient for the purpose of providing for the maintenance and support of my said daughter Mary Jane so long as she shall live and remain unmarried. In the event of my said executors seeing fit to sell or dispose of any part of my said property the proceeds shall be invested and the interest thereof devoted to the maintenance of my said daughter but provided that in case for any special reason it shall seem necessary to them my said executors shall be at liberty to pay to my said daughter or otherwise make use of for her benefit the whole or any part of the principal monies or proceeds.

FIFTH: Upon the death or marriage of my said daughter my property shall be distributed as follows:
(A) I leave and bequeath to my daughter Mary Jane Chafe absolutely that part of my house and the appurtenances thereof which I at present occupy (being the South West portion there of) together with the whole of the garden situate in front of the house and between it and the river together with all necessary rights of way to the main road from the said part of the house from both front and back, and also from the garden.
(B) to my son Samuel the remainder of my farm at the Goulds (that is to say the part not included under Grant numbered 2121 above mentioned) together with that part of the house which he at present occupies.
(C) to my grandson Hugh son of Henry Williams that piece or parcel of land situate on the West side of the Goulds Back Line the same being comprised in the Grant form the Crown dated January 25th A. D. 1882, and numbered 4470.
(D) To my daughter Mary Jane all my household furniture and effects.
(E) The remainder of my property wheresoever situate or of whatsoever kind shall be sold in whatever way may to my said executors seem most advantageous and the proceeds thereof in money together with any other monies which may then belong to my estate shall be divided in twenty one parts which shall be distributed as follows:

To my daughter Mary Jane six parts which if she shall die unmarried or without issue and shall not by Will otherwise appoint, shall be equally divided among the rest of the family;
to my daughter Fanny Rosamond Lee three parts;
to my daughter Sarah Ann Leard three parts; to my son Frederick three parts;
to my son Henry William three parts;
to my grandson Hugh son of Henry William two parts;
and to my son David Marshall one part, which shares are to be considered by my said children as being allotted to them according to their circumstances of prosperity or otherwise and not unequal for any other reason; my son Samuel receiving no part of the money on account of his having received a better part of the land than the others.
