Will of Edward Thomas

In re: EDWARD THOMAS DECEASED.

This is the last will and testament of me, Edward Thomas, of St. John’s Newfoundland, Carpenter and Builder. I hereby revoke all former wills and testamentary dispositions made by me.

FIRST. I appoint my two sons, Henry J. Thomas and James H. Thomas, and the survivor of them, executors of this my will.

SECOND. I direct that all my just debts and funeral and testamentary expenses shall be first paid out of my estate.

THIRD. I give, devise and bequeath the land and house known as No. 1 Bee Orchis Terrace on Queen’s Road in the city of St. John’s, and at present leased to J.W.N. Johnstone, to my son Edward A. Thomas and my daughters Sarah Harvey Whitmore in equal half shares, the said land and house to be owned by them as tenants in common.

FOURTH. I give, devise and bequeath the land and house known as No. 2 Bee Orchis Terrace, on Queen’s Road in the city of St. John’s, and at present leased to Harry A. Winter, to my daughter Elizabeth Absolutely, I also give to my said daughter Elizabeth all the household furniture in the house occupied by me and my wife and my said daughter; provided that my said daughter shall act with my executors in distributing to such members of my family as I shall have named to my said wife and daughter such parts of the said furniture as I shall have directed to be given to them.

FIFTH. I give, devise and bequeath the land and house known as No. 3 Bee Orchis Terrace on Queen’s Road in the city of St. John’s, and at present leased to Lamont Paterson, to my sons Henry J. Thomas and James H. Thomas in equal half shares, the said land and house to be owned by them as tenants in common. I make this gift of the said property, which is the most valuable on the said Terrace, in the wish and expectation that my said sons will perform their duties as executors of this my will free of all charge except for out-of-pocket expenses.

SIXTH. The three gifts immediately preceding are made subject to the condition that there shall be paid annually out of the rents and profits of each of the said three properties the sum of four dollars towards the maintenance of the Congregational Church in St. John’s, making twelve dollars in all, the said gift to be expressed as being made out of my estate.

SEVENTH. I direct that, should my wife Sarah Jane become sick or invalid and require the services of a Doctor or Nurses for her attendance and comfort, the expenses of the same shall be paid out of my estate.

EIGHTH. I give to my granddaughter Ethel, the daughter of my son George, the sum of one hundred and fifty dollars.

NINTH. I direct that any money of which I shall die possessed shall, after my payment of my debts, testamentary and funeral expenses and of the aforesaid legacy to my granddaughter Ethel, be divided equally between my sons, Henry, James and Edward, and my daughters Elizabeth and Sarah.
