In re: EDWARD J. MALONE . DECEASED.
This is the last will and testament of me Edward J. Malone of Saint John’s Tailor.
1. I give devise and bequeath all my property estate and effects of every description to my executor hereinafter named upon trust to invest the same and to pay the income thereon to my wife Sarah Ann Malone or to permit her to have the use of the same during her natural life with power to my said executor to keep any investments existing at the time of my death and to vary any investments and to invest in mortgages upon land and property in Saint John’s.
2. I further give to my said executor power in his discretion to realize any portion of my estate and to pay to my wife out of the proceeds thereof such sum or sums in addition to the income of my estate as may in the opinion of my executor be necessary for her suitable maintenance and support during her life.
3. On the death of my said wife I give devise and bequeath such portion of my estate as shall then remain to my nieces Florence Croke Mary Croke Olive Croke Catherine Croke and Myrtle Croke children of James Croke of Saint John’s or to the then survivors of them share and share alike.
4. I appoint James Croke of Saint John’s executor of this my will. Witness my hand at Saint John’s aforesaid this 21st day of June Anno Domini one thousand nine hundred and twelve. E. J. Malone. Signed published and declared by the said testator as and for his last will and testament in the presence of us who at his request in his presence and in the presence of each other all present at the same time have hereunto subscribed our names as witnesses W.O’.D.
