Will of Edward Kennedy

In re: EDWARD KENNEDY. DECEASED.

In the name of God Amen. I Edward Kennedy of Foxtrap South Shore Conception Bay in the Island of Newfoundland Fisherman & Farmer, being weak in Body but of perfect mind & memory do make and ordain this my last will and Testament

First I give and bequeath unto my wife Jane Kennedy, my dwelling house, goods & chattles, stable, cellar Flakes and the use of the Caplin Seine, horse & carts harness & cattle and all my cultivated and uncultivated land north of the Railroad (except a piece of land that I intend to give to my son James) for her sole use and benefit while she is alive. after her death my grandson William James Butler is to take possession of all that I have bequeathed and given to my wife, on the following conditions that he is to support my wife and do all in his power to make her comfortable. If failing to support her and is unkind to her or should leave her, I give her power to bequeath all the property I have given her to those that are the kindest and best to her

To my son James Kennedy and my grandson Edward John Kennedy I give and bequeath all the land that I possess inside the Railroad to be equally divided between them there being about between nine and ten acres bounded as follows on the south by Richard Ridout, East by local road. west by Robert Hayes and on the North by Albert Butler and my son James land. My son James must remove either the store or house he is living in and place it on the land I have given him inside of Main road. I also give and bequeath to my son James that piece of land north of the Railroad and bounded on the north by John Butler. East by local road- west by the river the letters A. K. cut in a rock being my north west boundary and south by my own land there being no fence only a few stakes as a boundary line or mark My grandson Edward John Kennedy must remove his fathers dwelling house and stable and place both on the land I have given him inside the Railroad on the land called Dunns Hill

Further I give to my daughter Abigail and her husband Albert Butler the piece of land they have cleared near the pond & at their death I desire it to go to my grandson William James Butler according to the conditions above named.

My Caplin Seine while it holds together is for the use of all my family especially for my wife and the grapnels and loose gear are for the use of all my family while they last. And I do hereby utterly disallow, revoke and disannul all and every other former Testament, Wills and bequests ratifying and confirming this and no other to be my last will and Testament.
In witness whereof I have hereunto set my hand and seal this 12th day of July in the year of our Lord one thousand eight hundred and ninety three Edward X (his mark) Kennedy.
