This is the last will and testament of me Charles Ellis of Saint John’s in the Island of Newfoundland     I give and bequeath to my wife Jane Mary Ellis for her own use and disposal all my household furniture and to whom I also give and bequeath during her lifetime the rents profits and arrears that may arise or be due from my share of portion of the property known as Ellis’ Estate and from and after the decease of my said wife I give devise and bequeath the said share or portion of the said estate and all my right title and interest therein to my two sons Charles Ellis and Henry Ellis both residing at Saint John’s aforesaid subject as hereinafter mentioned upon condition that they or the survivor of them his executors or administrators within twelve months from my decease well and truly pay to my daughters Jane Gibbs Elizabeth Major and Selina Sterling each the sum of one hundred pounds currency and to each of my grandchildren the daughters of my deceased son William Archer Ellis the sum of twenty five pounds currency the said respective sums to be for the use and benefit of my said daughters and grand-daughters free from the control or liabilities of any husband and for the due payment of the said amounts the said share shall remain as security and in the event of the death of either of my said daughters then the said sum shall be paid to her representatives.     It is also my will and desire and I direct and bequeath that should either of my said sons predecease my said wife the survivor of them at her death shall for himself his executors administrators and assigns have possess and enjoy my said share or portion of the estate aforesaid with all my right and interest therein Provided that in addition to the sums aforesaid he or they pay to the representatives of his deceased brother within twelve months from my decease the sum of one hundred pounds currency     Lastly I revoke all former wills and codicils and I appoint my said sons Charles Ellis and Henry Ellis or the survivor of them executors of this my last will and testament     In witness whereof I have subscribed my name and set my seal at Saint John’s aforesaid this twenty-fifth day of May A.D. one thousand eight hundred and seventy.     Charles Ellis (LS)     Signed sealed published and declared by the said testator as and for his last will and testament in the presence of us and of each other, W.H.
