Will of Catherine Sullivan from Newfoundland will books volume 2 pages 581-582 probate year 1865

In re
         Catherine Sullivan deceased.

This is the last will and testament of me Catherine Sullivan of Saint John’s in the Island of Newfoundland Widow, of the late Denis Sullivan, formerly of Saint John’s Dealer-

First- I will and direct that all my just debts funeral and testamentary expenses be forthwith paid by my executor hereinafter named:

Secondly- I give devise and bequeath unto Patrick Hagerty of Saint John’s aforesaid Cabinet Maker all the lands houses messuages moneys goods debts and effects of what nature or kind soever of which I may die possessed either in my own right or by virtue of the terms of my the last will and testament of my late husband Denis Sullivan or in right of my late son Daniel Sullivan now deceased to have and to hold all such lands houses messuages moneys goods debts and effects above mentioned unto the said Patrick Hagerty his executors and administrators for ever. Upon the express trust and condition- To pay and appropriate year by year the rents issues and profits arising therefrom and thereout, unto and to and for the sole and separate use and benefit of my daughter Johanna Barron wife of Pierce M. Barron for the term of her natural life freed and cleared and free and clear from the control or interference of the said Pierce M. Barron, and free and clear of any debts now due and owing or that may hereafter at any time become due and owing from or by the said Pierce M. Barron.

Thirdly Upon the further trust and condition in the event of the death of my said daughter Johanna Barron to pay and appropriate the rents issues and profits arising from the lands and other property and moneys above mentioned to and for the use and benefit support maintenance and education of the children of the said Johanna Barron share and share alike, until the youngest of such children shall attain the age of twenty one years- Then upon the further trust to distribute devise and assign to such child (and if more than one to such children share and share alike) all the before mentioned lands houses messuages moneys goods debts and effects to have and to hold the same unto him or her or them or each of them and his or her assigns for ever.

Fourthly, And in the event of the death of the said Johanna Barron leaving no child her surviving then upon the further trust to assign and convey the lands houses messuages moneys goods debts and effects above mentioned unto such person or persons and for such purposes as the said Johanna Barron may by any last will and testament direct and appoint.     I hereby nominate and appoint the above named Patrick Hagerty sole executor and Trustee to carry into effect this my last will and testament And I hereby expressly revoke annul and disallow any former or other will or wills testament or testaments by me made hereby ratifying and confirming this as my last will and testament.     Dated at Saint John’s in the Island of Newfoundland this twenty sixth day of November Anno Domini one thousand eight hundred and sixty four.     Catherine her X mark Sullivan (LS)     Signed sealed published and declared by the said Catherine Sullivan the testatrix above named as and for her last will and testament who executed the same by affixing her mark thereto in the presence of the undersigned witnesses who in the presence of each other and in the presence of the said Catherine Sullivan and at her request affixed their names as witnesses hereto-     The said will having been read over and explained to the said Catherine Sullivan before the execution of the same, Thos. J. Kough,     Edward Kavanagh.
