Will of Catherine Fahey

In re: CATHERINE FAHEY DECEASED.

This is the last will and testament of me, Mrs. Catherine Fahey Bay Bulls District of Ferryland hereby revoking all wills Testaments or codicils by me at any time heretofore made. I devise and bequeath all my estate, real and personal, to my executors and trustees hereinafter named in trust for the purposes following:

Firstly, to pay my just debts, funeral and testamentary expenses, and thereafter in trust to dispose of and pay over or convey the same to the person or persons or corporations hereinafter named as follows:

My real estate and buildings situated at Kilbride on the Bay Bulls Road district of St. John’s West to my husband Andrew John Fahey during his life time and after his death said real estate and buildings situated at Kilbride on the Bay Bulls Road district St. John’s to go to my two sons Andrew J. Fahey and Richard Fahey. I also advise and bequeath my house and lot situated on Cuddity St. In the City of St. John’s, N. F. To my husband Andrew John Fahey, I also empower my husband if at any time he deemed it prudent to sell said property to do so and the money obtained from said property to be given to my grandchildren, namely Allice, Andrew and Geneive Chisolm three hundred dollars ($300) when they become 21 years of age, money to be deposited in Bank for them when property sold, the balance if any to be divided equally among my five daughters May Catherine, Genevive, Johannah, Gertie, and Catherine. If said property is not sold during my husbands lifetime after his death said property to be divided equally among my five daughters namely, May Catherine, Johannah, Gertie, Gevenivie, Catherine. I also bequeath my Organ and sewing machine to my daughter Catherine.

I nominate, constitute and appoint Andrew John Fahey of Bay Bulls Newfoundland, Constable as executor and trustee of this my last will, with full power and authority to sell and dispose of all my estate where necessary, and execute any and all Documents requisite to carry out this my will, and should one or more of my said executors or trustees wish to retire I authorize them to appoint a successor instead thereof.

In witness whereof, I subscribe these presents as printed and written this 16th day of December A. D. 1921. CATHERINE FAHEY.

Signed published and declared by the said Testatrix as her last will and testament in the presence of us both present at the same time who in her presence and in the presence of each other have hereunto set and subscribed our names as witness Cleary Williams Bay Bulls.
