In re ALEXANDER SCOTT. DECEASED.

This is the last will and testament of me, Alexander Scott, of Washington, in the County of Orange, in the State of Vermont, formerly of St. John’s, in the Island of Newfoundland. 1st. I desire that all my just debts and funeral and testamentary expenses and all existing encumbrances on home place be paid out of proceeds of Life Insurance Policy held in the Mutual Life Insurance Company of New York. 2nd. I give and bequeath to my wife, Mary Scott, of Washington, VT, the remainder of the proceeds of Life Insurance Policy held in the Mutual Life Insurance Company of New York, after paying expenses, debts and encumbrances as above stated. 3rd. I direct that proceeds of Life Insurance Policy held in Canada Life Insurance Company of Toronto, Canada, be added to, and become a part of, money loaned to, and used in carrying on, the dry goods business in St. John’s, Newfoundland, and draw same rate of interest. 4th. I give and bequeath all my interest in the partnership business at present carried on at St. John’s, Newfoundland, by me and H. R. Burt, under the style of “Alex Scott” and all my interest in the assets of said business, and also all moneys loaned to, and drawing interest in and from, said business to my wife, Mary Scott and my sister, May Scott, both of said Washington, to be divided between them as follows: two thirds to my wife, one third to my sister, May. 5th. I desire that my said wife and sister, May, shall leave principal of capital and loans in said business, drawing therefrom only their respective proportional shares of profits and interest, with share of annual reduction of capital, as arranged in existing agreement. 6th. I give and bequeath to my wife and sister, May, all my interest in lease land and buildings thereon located at and known as No. 14 and 16, New Gower Street, St. John’s, Newfoundland, to be equally divided between them. 7th. Upon the death of either my wife or my sister, May, I desire that the survivor shall have the whole income from said dry goods business and real estate during the remainder of her life. 8th. I further desire that upon her death the said survivor shall provided by will, or other wise, that the said properties shall be vested in the Trustees of Gower Street Methodist Church, St. John’s, Newfoundland, and by them invested, and yearly income be by them equally divided between the Missionary Society of said Church and the Poor Fund of said Church, or otherwise, as they may determine. 9th. I give and bequeath the balance, residue and remainder of my estate to my said wife, Mary Scott. 10th. I hereby nominate constitute and appoint my wife, Mary Scott, and Martin W. Chamberlain, both of Washington, in the County of Orange, in the State of Vermont, jointly and severally to be executors of this my last will and testament. In case of the death of either of them, the survivor shall then be sole executor of this my will; and to such survivor I give all the power and discretion which I have hereinbefore given to my said executors. I also give to each of them all the power, and commit to each of them severally, every confidence and trust that I have given to them jointly; provided, however, that the one who shall act shall have the consent of the other executor. And I hereby revoke all former wills and codicils by me at any time made. In testimony whereof, I hereunto set my hand and seal, and do publish and declare this to be my last will and testament, at Washington, in the County of Orange, in the State of Vermont, on this 15th day of July, in the year of Our Lord, 1919.
