In re
John Dambrill deceased In the name of God Amen I John Dambrill of Saint John's in the
Island of Newfoundland, House Carpenter, being infirm in body but of sound
mind memory and understanding do make and ordain this my last will and
testament in manner and form following, that is to say, I give
devise and bequeath unto my Executors, hereinafter mentioned All my Fishing
Room or rooms and plantation situate in Saint John's aforesaid or elsewhere,
with the buildings and erections thereon and all the Appurtenances thereto
belonging or in any wise appertaining, and all other lands, houses, tenements,
goods, chattels, effects, or property whatsoever, which I may die possessed
of, or at the time of my decease be entitled unto in any manner or way
howsoever, Upon Trust that the same and every part thereof with all the
rents issues and profits therefrom arising [my just debts and funeral expences
being first thereout paid] be allowed unto and for the proper use and behoof
of my wife Jane Dambrill for and during the term of her natural life, hereby
authorizing and allowing them my said executors, with the consent and concurrence
of my said wife to make, and execute any such lease or leases of the whole
or any part of the Fishing Rooms or other property hereby intended to be
devised to any person or persons for such term and upon such conditions
as they my said executors with the consent and concurrence aforesaid may
think proper or be advised to grant. And after the decease of her
my said wife, upon this further trust, that they, my said executors or
their legal representative for the time being, do then forthwith as soon
as conveniently may be, cause and procure all the aforesaid property, hereby
intended to be bequeathed, to be fairly and equally divided between my
then surviving children or their heirs, share and share alike as near as
the same may or can be done.
