In re
Thomas J. Edens deceased.
In the name of God Amen. I Thomas J. Edens of St. John's, Merchant,
do make, publish and declare this as and for my last will and testament.
First. I hereby revoke all former wills and testaments made by
me.
Secondly I appoint my wife Margaret Edens to be sole executrix of this
my will.
Thirdly. I give devise and bequeath to my wife, Margaret Edens,
all the property, estate and effects of which I may die possessed to have
and enjoy the same for and during the term of her natural life and after
her decease I give devise and bequeath the same to my children living at
the date of the decease of my wife in such shares and proportions as she,
my said wife, shall by deed or will appoint and in default of such appointment
to my said children in equal shares.
Fourthly. I declare that all investments shall be made at the
absolute discretion of my said wife and further that should my said wife
in her discretion desire to continue the business carried on by me at St.
John's I empower her to do so for as long as she shall think fit and to
discontinue the same at any time and to sell the same or wind up the affairs
thereof, with liberty to my said wife, if and so long as she shall continue
the business, to employ therein the whole or any part of the capital which
shall be employed therein at my death and also such further part [if any]
of my estate as she shall think proper and to employ managers agents and
clerks and generally to act in the conduct of the said business as she
shall in her absolute discretion think fit, without being answerable for
any loss arising thereby.
Fifthly. I give devise and bequeath to my said wife Margaret
Edens the sum of one hundred dollars to be paid by her for the celebration
of masses for the repose of my soul.
In witness whereof I have set my hand to this my last will and testament
this 27th day of June Anno Domini one thousand nine hundred and ten.
