Will of Patrick Smith of  Witless Bay

In re 
Patrick Smith [of Denis]            deceased

 In the name of the Father and of the Son, and of the Holy Ghost Amen.  This my last will and testament of me Patrick Smith [of Denis] I revoke all other wills.  I hereby declare that all my land and tenements goods and chattels money and property of every kind and nature shall become property of my family in the manner herein mentioned viz.  To Anastasia ne(?) Gettigan, James M. Smith, John B. Smith, Joseph Smith [my sons and daughters] one hundred dols each.  Patrick Smith Jr., and Michael Smith to have the property at Witless Bay.  The property brought from Rev. Michael O'Driscoll with Mrs. Shortall garden divided between them half each.  Michael the west part 40 feet fore Shore, and Patrick 40 feet fore shore the one landing place will suit each party, the remainder for the use of each.  Michael to leave a car road through his part for Patrick's use the garden where Michael's house stand is to be his property half the cellar & half the new store each.  If at any time Joseph should want to build on the waterside property he is to have one third part.  My daughter Katie Burke is to have the house 47 Patrick St, garden, furniture beds & beddings also piano.  The Green hill half each to Michael, and Patrick.  After these donations are paid Katie is to have the balance of money remaining for her own use.  She is also to call William S. Smith [my grandson] and send him to school if his father allows him to remain here.  Arthur Smith to receive $100.00 [one hundred dol] also, one hundred for poor Priests.  Michael & Patrick are to pay and 1 dol each per year for masses for self and family.  The leased property I now hold at Witless Bay is to be divided between Patrick & Michael Smith half each.  After William S. Smith is sixteen years old his father is to look after and pay expenses.  Dated at St. John's this 28th of September one thousand nine hundred and sixteen.  Signed and delivered by said Testator as and for his last will and testament in the presence of us presence at the time who in his presence have here with signed our names as witnesses.  Patrick Smith of Denis.   Witnesses    Jas J. Pippy     C.C. Michael     J. Blacker.  I Patrick Smith of Denis the testator of said will named do hereby make this a Codicil to the said will namely, I hereby nominate Patrick J. Burke of St. John's to be Executor of my said will.  St. John's this 28th day of September 1916
