WILL of RACHAEL (THISTLE) MCKIE

IN THE NAME OF GOD AMEN.

I Rachael McKie of St John's in the Island of Newfoundland widow of Peter McKie late of the same place Esquire. Being of sound mind and memory But remembering the mortality of my body do make this my last will and testament in manner following also I do appoint my Son in-law William Tarbot of Liverpool Merchant _____ ____ of Woolworth in the county of Kent. A Captain in the Royal Navy and my worthy friend Thomas Goldsworth Brookings of the city of London merchant Executors of the same having by deed bearing date the third day of September last settled and disposed of all my real estate in trust for my children. ______therefore my will is and I do so direct that so soon after my demise as may be practicable my said executors do sell and dispose of to the best advantage and convert into money all my household furniture moveable and personal property whatsoever and wheresoever and out of the proceeds there of and shall pay and discharge all my debts and funeral expenses as also the expense of proving this my will and I do hereby further direct and my will is that my said executors shall and so collect realize and convert into money all my monies debts and activities for money of what kind? or nature soever as well in Greater Britain as( over here and?) that they my said Executors shall and do divide the whole of my said personal estate as realize together with the surplus proceeds of my moveable property into four even and equal shares and proportions this I do hereby directly give and bequeath with one fourth share of my said personal estate to and among the children of my late daughter Rachael Tarbot wife of Wiliam Tarbot afore said share and shares a like the same to be applied to and for the Benefit of the said children in same? manner as their father the said William Tarbot shall deem most advisable for their interest. I do give and bequeath unto cash? of my daughters Agnes O'Farrell and Elizabeth Bullock respectively one fourth that of my said share personal estate and I hereby direct my said Executors to pay the said fourth share into the hands of them the said Agnes O'Farrell and Elizabeth Bullock respectively for their sole and separate use free from the debts or controll of any husband or husbands with whom they or either of them is or are unmarried or may intermarried. And I do hereby direct that the receipts or receipt of them the said Agnes a O' Farrell and Elizabeth Bullock respectively or of both persons or a person as they or either of them shall appoint shall be as to sufficient discharge or discharges for her or their shares or respective share aforesaid And as to the remaining fourth share of my said personal estate I do give and bequeath the same unto the said William Turbit Fredrick Bullock and Thomas Goldsworth Brookings and the survivors and survivor of them his executors administrators and assigns upon and for the trusts interests and purposes following that as to say upon trust that is they the said William Tarbit Fredrick Bullock and Thomas Goldsworth Brookings and the survivors and survivor of them his executors administrators and assigns shall and do pay out and invest the same on interest to the best advantage either in Great Britain or elsewhere as they may think fit And from time to time after vary? and transfer the monies to laid out and invest for or unto other activities of the like nature as they or he shall think advisable. And upon this further Trust that they the said trustees or trustee for the time being his executors administrators or assigns do and shall during the lifetime of my daughters and Caroline daughter wife of Thomas Frocsili? Langarne pay the interest dividends and yearly profits of the said monies so paid out and invested as aforesaid unto the hands of her the said Caroline's daughters or to such person or persons as she shall whether revert? _______ or sold by any writing under her hand from time to time appoint to the intent that the same maybe for her support? and not subject to the debts collected or interference of her personal or any future husbands and the receipt or receipts of the said Caroline daughter for the said interest dividends and ready profits or of the persons or person she shall appoint to service the same house shall_____ ___ together she shall be____ or sold be an official discharge or official discharges for the money otherwise therein authorized to be(recorded? also from and after the death of the said Caroline daughters and upon trust that they the said trustees or trustee for the house being? the executors and administrators or assigns do shall pay and apply the said interest dividends and yearly Profits accruing as afore said to and for the support education and maintenance of the children of the said Caroline daughters yearly until the youngest child shall and obtain the age of twenty one years when upon which_______ I do hereby direct the said trustees or trustee for the time being his executors or administrators or assigns to pay transfer and distribute the said principle monies paid out and invested as afore said and comprising the said fourth share to and among the children of the said Caroline daughters who may now be living in even as equal porportions share and share alike. Lastly I do thereby revoke annul and make void all former wills by me at any time made In witness whereof I have this twelfth day of April in the year of our Lord one thousand eight hundred and thirty seven to this a my Last Will and Testament set my hand and seal at St Johns in the Island afore said Rachael Mckie Day Signed and sealed by a the above named Rachael Mckie and by Act published and set forth as for Her last will and testament in the presents of us whom have hereto in her presence and in the presence of each other as subscribed our named as witnesses Daniel S. PROVED at Sunday the 13th Jan. 1845 before the Judge by the oath of William Talbot and the Executors to whom _____was granted having been first sworn By Commission only to administrator. Power reserved of making the life grant to Elizabeth Bullock Esquire and us Thomas Goldsworthy Brooking the office Executors when they shall apply for the same.
