In re
Thomas Tracey deceased. This is the last will and testament of me Thomas Tracey of Saint John's in the Island of Newfoundland, Fisherman. I give and bequeath unto my friend John Williams of Bay Bulls in the Island of Newfoundland Planter all the property of which I shall die possessed or entitled to at the time of my decease or over which I have a disposing power whether the same consists wholly or in part of estates of freehold, copyhold or for years, money in the Funds or otherwise out upon security or at Interest, book or other debts Stock in Trade and what ever other sort or kind the same or any part thereof may be, I give devise and bequeath the same and every part thereof unto the aforesaid John Williams his heirs executors administrators and assigns Upon Trust that he the said John Williams his heirs executors administrators or assigns do and shall with all convenient speed after my decease sell and dispose of so much thereof as will satisfy and discharge all my just debts which shall be due and owing by me to any person or persons whomsoever at the time of my decease or which shall afterwards accrue due, and in the next place to discharge my funeral expenses, and after full payment and satisfaction thereof then in trust to convey all and singular my freehold copyhold and leasehold estates and premises with the appurtenances onto Elizabeth McLeane the wife of Lachlin McLeane of Saint John's Newfoundland, aforesaid Mariner with whom I have resided for many years past and for whose care of me during my old age and infirmities I am greatly indebted to her, and also in trust to pay over to the said Elizabeth McLeane the balance which may be due from the said John Williams to my estate after discharging my debts and funeral expenses as aforesaid and also to deliver over to the said Elizabeth McLeane her executors administrators or assigns all my movable goods and chattels which may remain after the discharge of my debts and funeral expenses as aforesaid and authorize her to receive to her own use all debts which may then remain due and owing unto me. And lastly I do hereby nominate and appoint my said friends John Williams and Elizabeth McLeane Executor and Executrix of this my last will. In witness whereof I the said Thomas Tracey to this my last will and testament have hereunto set my hand and seal this twenty eighth day of May one thousand eight hundred and twenty four. Thomas his X mark Tracey. Signed, sealed published and declared by the said Thomas Tracey as and for his last will and testament in the presence of us, who in his presence and in the presence of each other have subscribed our names as witnesses hereto.
