In the name of God Amen.  I James Brien of Topsail Conception Bay District of Harbour Main Newfoundland, being of sound mind and memory but awre of the uncertainty of human life do make, and di(?)claim this my last will and testament,
First.  I direct my body to buried in the Roman Catholic Semerty at Topsail in place selected by one for my family Interment.  I bequeath and devise my real and personal property as follows - I desire my property on West side of Main Road be centraly divided from Main Road to Rail Track into equal Divisions My Daughter Tressa Mercer to have the South division and my son James O'Brien to have the North Division if he ever comes to claim it my daughter Tressa Mercer to occupy said North division until my son James O'Brien comes to claim it, and if he never come my daughter Theresa to have and hold the whole road side property - there is also three acres more or less on East Side of Main Road Directly opposite the aforementioned land, which I desire that my daughter Teresa Mercer shall have and hold.  I also give to my son James or Thomas O'Brien the first of them to come home, that piece or parcel of land situated by rail track and bounded as follows, on the North by Road known as Briens road on West by Briens Hill Road on South by land sold by me to Richard Hancock and on East by River.  In case neither of my sons never come home said piece of land to be the property of my daughter Teresa Mercer.  The debt of fourteen dollars, owned by Richard Hancock to me I hereby make the said Richard Hancock present of the above described fourteen dollars.  James O'Brien   X his mark.  Signed by James O'Brien and declared to be his last will and testament this thirteenth day of April 1917 in  presence of  Thomas Allen.  Joseph Miller.  April 13th.  1917
