In re
William Bennett. deceased.
I William Bennett of Bell Island Conception Bay Newfoundland being of
sound mind, memory, and understanding, do make my last will and testament
in manner and form following:
First. I give devise and bequeath to my daughter Lydia Bennett
the following.
[A]. My dwelling house and contents also land around house
inclosed by a fence measuring one acre more or less together with cellar
and all small houses erected thereon.
[B]. That piece & parcel of land known as "Upper Place"
containing four and one half acres more or less situated near the Anglican
Church, also that piece of granted land adjoining west of "Upper Place"
& containing four acres more or less.
[C]. That piece & parcel of land at the Beach with
store built upon it also ground rent of store owned by U.K. Martin and
built upon said piece of land.
[D]. My cow nine sheep and lambs.
[E]. All my money on deposit in the Bank of Montreal St.
John's, at the time of my death.
Second. I give devise and bequeath to my son John Henry Bennett
and my daughter Lydia Bennett that piece and parcel of land known as the
"Cow Meadow" and containing three and one half acres more or less to be
divided between them as follows: The east side together with stable to
my daughter Lydia the West side to my son John Henry.
Third. I give devise and bequeath to my daughter Mary Ann Squire
that piece and parcel of land situated near the C.L.B. Armoury and containing
one acre more or less together with all houses and property thereon.
Fourth. I give devise and bequeath to my son John Henry Bennett
the following:
[A]. That piece and parcel of land known as Fancy Hill
Meadow containing five acres more or less.
[B]. That piece and parcel of marsh land known as my grazing
ground situated near John Kennedy's place at East End, and bounded by land
owned by James Bowdring, James Normore and Solomon Normore and East End
road and containing two acres more or less.
[C]. My land known as "East End Meadow" containing one
half acre more or less comprised of two pieces of land divided by land
owned by late Thomas Power.
[D]. My part of the fishing room at the beach and known
as Fitzgeralds fishing room.
[E]. My mowing machine.
Fifth. I give devise and bequeath to my three daughters Elizabeth
Anderson, Catherine Butler, and Mary Ann Squire that piece and parcel of
land containing one half acre more or less situated at the mines and bounded
on the South by Bennetts road on the West and North by land owned by Diocesan
Synod and on the East by Martins line to be together with rents accruing
from same divided equally among them.
Sixth. I give devise and bequeath to the Rector and Church wardens
of St Boniface Church and their successors the small dwelling house and
land on which it is built measuring from East to West twenty three feet
and from North to South 100 one hundred feet more or less situated at the
mines and at present occupied by Albert Heath, Barber, the rent of house
and land to be used for the upkeep of the Old Church of England Graveyard
on the "Lookout" Any money remaining over after upkeep of said Graveyard
to be given as a subscription annually to the Diocesan Mission Fund, otherwise
known as Church Dues, in memory of me the testator.
Seventh. I give devise and bequeath to my daughter Lydia Bennett
and my son John Henry Bennett that piece and parcel of land, subject to
clause six of this my will and testament known as "The Green" situated
at the mines and bounded on the North by Martins line and Bennetts road
on the West by RC Chapel and on the South by Bennetts road extending to
meet Martins line on the East, to be divided as follows: To my daughter
Lydia the West part extending from the RC Chapel eastward to and including
the small house and shop owned by Mr. Charlie Sapp thence by a line running
South to meet West boundary of land rented from me by Amon Basha.
To my son John Henry Bennett the remaining Eastern portion of land extending
from aforementioned line to Martins line on the East. In the event
of the marriage of my daughter Lydia her portion of land described in clause
seven of this my will and testament together with all rents accruing from
same to be thereafter equally divided between my four daughters Elizabeth
Anderson, Catherine Butler, Mary Ann Squire, and Lydia Bennett.
Eighth. I give devise and bequeath to my three daughters Elizabeth
Anderson, Catherine Butler and Mary Ann Squire and my son John Henry Bennett
to be equally divided between them my money in stocks viz Five Hundred
Dollars in the Bell Island Transportation Co. Five Hundred Dollars
in Victory Bonds and all money on deposit in Bank of Nova Scotia Bell Island
at the time of my death subject only to the payment of my just debts, funeral
and testamentary expenses and the charge of proving and registering this
my will.
Ninth. I hereby appoint the Revd. J. Stead. Clerk in Holy
Orders, Executor of this my last will and testament. In witness whereof
I, William Bennett, the testator have to this my last will and testament
set my hand and my seal this Seventh day of June A.D. one thousand nine
hundred and nineteen. William Bennett Sr. Signed sealed and declared
by the above named William Bennett as and for his last will and testament,
in the presence of us, who have hereunto subscribed our names at his request,
as witnesses thereto, in presence of the said testator and of each other.
